Joint Custody Question

Hello Again, everyone.


I have a 6 year old son and his mother and I have Joint custody of him. I pay her child support every month. She has him primarily and I have him on weekends. She is married and I am as well. My wife will be sponsoring me to come to Canada (I'm form the US). I have already done the medical exam for him and he will be staying with his mother (she has no problem with that).

My question is: Will this pose any sort of problem or delay in our application? Should we take any kind of special precautions and include the Custody papers that show we have joint custody? Will CIC want to see anything or ask why I'm leaving and not taking him with me? Should I get a letter from his mother stating that he will not be coming with me? If so, does it have to be notarized?

You have done what the applicant is supposed to do in this case: get the child examined, and include them in the application as non-accompanying.
I would include the papers proving joint custody, and proof that you pay child support.
CIC will not be suspicious because the child is staying with his mother. It should not delay your application. What does (or can) delay the application is when the custodial parent refuses to let the child be medically examined.
The visa officer does like to see that the stepparent has a relationship with the child, so you might include some photos of your wife with him. This is not a big deal for an American, though.

happy to know!!! thank you!! i was worried i'd have to get some kind of letter from his mom. i just wanted to cover all my bases and not have to go in for an interview and delay the process. thank you, again!
