Folks, need an advice-
I did work for employer X in canada from Mar-2016 to Jan 2019
I return to Canada for same employer in Dec-2021 and they gave me a job offer for PR too.

what should i answer for this question while creating the profile-
Has Mr. ABC been working full time for the employer on their current work permit for at least one year?

You can change the answer to "yes" once you hit one year from the time you returned to work for them in Canada Dec 2021.

Thanks Scylla, i could always change on Dec 2021 but if i say no Now, i don't get 50 points for the job offer. and for the job offer, no where its written that you should complete a year first.
This is what they say-
If you have a valid job offer it means that:
a Canadian employer has offered you a full-time, non-seasonal job for one year or more, and
you have a valid Labour Market Impact Assessment (LMIA) number, or
the job is exempt from needing an LMIA.

Do you hold a closed work permit that is LMIA exempt?

Yes Scylla- i am falling under below condition [ However i did work for the same employer from mar-2016 to Jan 2019 in the same type of Work permit that i have now]

if you have a valid work permit for a NOC 0, A or B job that is exempt from needing an LMIA, and you:
are currently working for an employer specified on the work permit
have one year of full-time work experience (or an equal amount of part-time work) for that employer
have a valid job offer from that employer for at least one year after we issue your permanent resident visa

In that case the rules most definitely say that you must have at least one year of work experience with your employer in Canada on your current work permit before you can claim the 50 points.

The line you quoted above "have one year of full-time work experience (or an equal amount of part-time work) for that employer" refers to having at least one year of work experience in Canada on your current work permit. That's why you aren't getting the 50 points if you answer "no" to the one year question. You need to wait until December to claim the 50 points.

Can i answer the field saying "Yes" for now and get an ITA and submit the document after the day i complete a year which is about 6 weeks from now, I would have 60 days to file
Is that legitimate?

I cannot recommend that. That means you would be committing misrepresentation at the time you receive ITA. Wait until you have the full year to avoid problems. A number of things are locked in at the time you receive ITA. You want to avoid any chance of misrepresentation. Your call of course.

Thanks for the advice. I would agree with you
