My friend has been living in the U.S. for approximately 15 years now on a TN Visa. She has met an American Citizen and is now pregnant. She plans to go home to Canada to have the baby and return to the U.S. prior to her leave of absence running out in about 12 weeks. The child obviously will be a Canadian citizen but will he automatically be admitted back into the U.S. with her because of her TN visa??

If she marries boyfriend before baby is born can they apply for dual citizenship on the child.

Does a child having dual American/Canadian citizenship have any bearing on a parent receiving citizenship in either country?

They are considering immigrating to Canada eventually he will be a physician.

Do misdemeanor convictions like public intoxication have any bearing on immigration status to canada.

If she's on a TN visa, her child automatically gets a TD visa, which is a visa issued to the dependents of a TN visa holder.

Yes, a US misdemeanor will affect Canadian PR if they don't get a pardon I think.

Sure, if they get married, or the child is born in USA, the child becomes an automatic US citizen, but this has nothing to do with the parents becoming citizens.

Next question..... I have been on a TN Visa for 15 years which expires in a couple of years. I have an approved I140 application with an inclusion date of 2007. I am becoming a little freaked out as my hospital in the united states has several filapino nurses that will soon be going home because their allotted time has run out and they can no longer get extensions.

Are the filapino nurses different in the eyes of the U.S. compared to Canadian nurses on TN??

With all the issues with immigration, unemployment, and illegal immigration it would seem that the wait has become ridiculous for permanent residency.

Please Advise

If the father is American, the child is almost certainly a U.S. citizen no matter where it is born, and can remain in the United States indefinitely. (The specifics: if one parent is American, the child is American as long as the parent is a citizen and has lived in the U.S. for five years at the time of the child's birth, and two years out of that five was after the American parent's 14th birthday. Most Americans who grew up in the U.S. will meet these criteria and thereby pass their citizenship by descent.)

[edit] Something important that I forgot to mention: some provincial health insurance plans, OHIP notably among them, require you to reside for three months in that province before you become eligible for the health plan. This means that if you move to Ontario and give birth before you've resided there for three months, you will pay all costs out of pocket.
