After reading some posts this morning about a possible misrepresentation due to the fact that someone failed to mention the TRV had me thinking. I promised myself that I wouldn't go back to see if there are any mistakes in the application. On the form for Background/ Declaration we did check off that he was 'refused admission to........' and in the details we wrote the times that we AS A COUPLE applied for TRV's and were denied. Prior to my husband and I's relationship he had been invited by friends to Canada so he tried for the visa and obviously was denied.
Serious question: Could we possibly get charged with misrepresentation because he didn't mention the TRV before we were together? I guess when we answered the question we didn't consider writing the other it down because he didn't know the exact date.
Side note: On the most recent TRV application we mentioned that we had a denied application prior. There was no issue or major concerns at that time in CIC's eyes about the visa before we were together.
I guess i'm a little over worried now that they might try to bring that out and put it against us. I'm hoping that if it wasn't an issue before then it won't be now. ::) T.I.A

So, basically your husband was denied twice? Once before he met you, and once after he met you. I think you have nothing to worry about. You already mentioned that he was denied TRV when we wanted to be with you. They will anyway dig up his name and match it against your statement. Since you didn't say that he wasn't refused (sorry, double negative), you did represent correctly, though may be not completely.

Misrepresentation is generally for more serious things - like saying you were not married before when you actually were, or that you didn't do any crime when you actually did and so on. You did the right thing by disclosing that at least one of the TRVs was denied previously. There is nothing more to worry about.

I tend to agree with ydj_dil. In my opinion (for whatever that's worth), CIC is more strict with misrepresentation for questions with a definitive "yes/no" answer. like the infamous "are you married or in common-law" question where if people say "no" when they are indeed in one, CIC is so strict about never allowing them to be sponsored. Things where you mix up dates a bit or forget an entry (like a past address/work) is not as big a deal. As ydj_dil already mentioned, it is good that you mentioned at least one of the TRV denials. So you did answer yes to if you were ever denied entry and forgot to list another one. Not as big a deal to me.

I guess one question I have is since you caught it before the application is finished processing, that you should update CIC with this. I'm not sure what the best thing to do is since I suppose that would potentially risk delaying the application. Curious what others think.

I would send an update to the visa office explaining you forgot to mention one refused TRV. No harm in it.

I think they are more strict if you actually check off "No" when you should have checked yes. Misrepresentation would be saying you were never denied any visa. You tried to be honest and that is the main thing. Like others said, update them and I think it should be fine.
