Is there anyone in here that know for sure if there is a law, when it comes to the undressed part of the exams...... Is there a law saying the dr has to have a nurse present when he does for example the breast exams?

Some I talked to say no and many others say yes.

But I haven't been able to find any answer online.......Im not so good with computers. Has any of you guys found the answer to this question online?

I would be so so grateful if you could help me with the answer to this question.
 
It is not a law that a nurse "must" be present, however the patient always has the right to have someone of the same sex present, if the examination is being done by a member of the opposite sex. This is generally for women being examined by male doctors, however the reverse would also apply.

Im hoping a computer expert, as so many of you are in here, will be able to find anything about this in their homepage. And I would be so grateful

3.1.7 Cultural sensitivities
Panel members must be aware that clients from some cultures may request special accommodation during the IME. Female clients, for example, may be uncomfortable with a male examiner, in which case panel members should offer to have a chaperone present during the examination.

Therefore, the breast examination part of the IME form (Question 35 on the IMM5419 Physical Examination) will only be completed for male or female clients, regardless of age, where the client or the Panel Physician (PP) has concerns regarding changes in breast(s).
Breast examination must be conducted with sensitivity and, in the case of a male doctor and female client, preferably in the presence of a chaperone. Any female client who is unduly anxious about undergoing the breast examination should be referred to a female physician for this examination

It's not mandatory, even if the woman asks for a female to be present. You can see that in the quotes Rob_TO gave you.

But the panel doctor must follow also the rules of the country they are working in. In what country are you doing your exam?

If a dr is doing an internal exam there should be a nurse in the room if the dr is one of the opposite sex. Either way, from your last post about your exam, you need to report him. What and how he did it was WRONG.
 
It's not law but most doctors doing a sensitive physical exam would have a female present. Many doctors do this as a matter of course as it protects them as well as helping to make a female patient more comfortable.

@doctors - I am so sorry this happened to you and I hope you found some peace in the last days. I understand your reluctance, personal and legal, in saying who the doctor was. All I can hope is that all the women reading your story will learn from it and always ask for a female to be present during their medical exam. And I hope that your PR comes quickly enough so that the statute of limitations does not run out and you can initiate legal proceedings. In other words: sue his a*s as soon as you feel comfortable with that. For you and your peace, not for anyone else. Stay strong!
 
What gets me about all this is that, during my wife's medical exam, the doctor stated, right up front, that this did not include a breast or gynecological exam. She did have to change into the standard "hospital" garb, but everything was very straightforward. Just stethoscope stuff and maybe some prodding around her neck.

I don't know if it is a "law" within CIC but I know from working in the emergency room that there is always a "chaperon" present when doing any type of in depth examination... this is in part to protect the doctor and much as it is to protect the patient.
