Is the baby Canadian?

Hi, I wasn't aware of the 2009 descent rule and here seems to be contradicting information on he gov website so I'm confused.

My brother (and I) were born outside of Canada - we are naturalized Canadian citizens (2005)
His baby was born outside of Canada (2016).
He, his wife (not Canadian) and the baby have not been back.

Is their baby Canadian? Can they claim citizenship for her?

Yes, the children of a naturalized citizen are Canadians.

What is that 2nd generation amendment all about, then? It reads that citizenship goes only to the 1st generation of non-Canadian born. Since the baby wasn't born in Canada, won't that technically make her 2nd generation since my brother wasn't born here either?

That only means when the baby grows up (as the second generation), he/she won’t be able to pass citizenship to his/her children

It only applies to Canadians who gained their citizenship by descent and not by naturalization. The child will however not be able to pass citizenship to it's own children via descent. Naturalization is treated the same way as birth in Canada for passing on citizenship.

Naturalized Canadian citizens are equated with Canadian-born citizens in this situation. The child is considered to be the 1st generation born abroad.
