Hi everyone. I have a very junior yet important question here:Is skilled worker application guaranteed to be accepted as long as your grade is above 67? Or is it still dependent on the discretion of the visa officer? I mean, for example, if he or she were in a bad mood when processing my application, can they reject my application even though my grade is above 67? Thank you a lot. :)
 
It is possible that the visa officer can estimate your points differently than you do. Maybe you misread the instructions and give yourself too many points in some category and the visa officer would correct that and give you less but if you have a solid 67 points, you should not be denied for points. It would still be possible to be denied if you had no 1 year continuous skilled work experience or because you fail the medical, because you fail a background check, because you lied about something and they found out etc.

Even if the visa officer gave you 67 points but finds inconsistencies in your job duties and the duties for your NOC, or incorrect information filled on the forms, any missing information or lack of proof of insufficient funds, your application can be rejected.
 
Hi there, thank you so much for your clear answer. Do you think now it is the trend that it becomes stricter and stricter? I mean, is the chance of being denied very high? I have a solid, or even too conservative self evaluation of 67, but I wonder if there is any implicit rules that I do not know? Thank you!

The only way it has become stricter is with the ministerial instructions. Before it was enough to have 67 or more points and at least one year of continuous skilled work experience as well as pass the medicals, background checks and provide proof of funds.

Now you also need to fit one of the 3 categories so if you are applying under category 1, you need to prove that your work experience really falls under one of the occupations on the list of 38 because people do try to cheat on that or if you are applying with an AEO, they will check that you are qualified for that job and can deny you if it looks like an incompatible job for you.

Is the score the higher the better or as long as it passed 67 will be ok? Does 67 = 99 ?
 
Dear Leon,

Im Aug 2007 applicant, all is good except im having difficulty with my work experience

* 2 years experience > Ref letter with out job description > plus the business is closed down (been 7 years)
* 2 years experience > Ref letter with out job description > this was in another country I have written CIC letter that my JD is as follows plus the business is not sending me another ref letter

sent with document update in Sept. 2009 as below

* 1 year exp > Ref letter + JD + Provisional contract copy
* 2 years exp > Ref letter + JD + Contract

will i get 21 points for work experience under the old SAP Procedure?

hello,
sydney office received my application on jan 28 ,2010 till today april 29 ,2010 i have not heard from them. does that indicate my application was denied or in worst case if i accidentally deleted my email is there any way i can query about my application.
