Hi all,

I have a question whether I can get 50 points for my immigration application.

I have been working for a Canadian employer since October 2017.

From October 30, 2017 to February 8, 2018 I worked part-time, 24 hours per week.
Since February 8, 2018 - currently have been working full-time, 40 hours per week.

I came to Canada on an open work permit (under International Experience Class - working holiday category). On February 8, 2018 I will have worked for more than 1 year full-time for this employer. My position is permanent, full-time, NOC 1123. I have a degree, etc. Since my position is permanent and my OPEN work permit is based on international agreement, isn't it LMIA except? Plus it's been more than a year since I have been working.

I'm lost.

Whilst you have a valid IEC WP you are LMIA exempt but that and your job being permanent would not give you 50CRS points. Your employer would need to provide a job offer of a 12months contract and obtain a positive LMIA unless the NOC code carries exemption.

The short answer is no.

Your employer needs to be listed on the work permit to get the 50 job offer points. Since you hold a working holiday visa, you have no employer listed on your work permit. Your employer needs to obtain an approved LMIA in order to get the 50 points.

"Jobs exempt from needing an LMIA
Your employer must get a new LMIA if:
  • your work permit has expired
  • you’re working on an open work permit
  • you have a job offer from an employer not listed on your work permit"
