My wife was denied PR after CIC jerked us around for 4 months after the interview, in the mean time Thailand is now under military rule I'm a bit concerned as my wife is very pro red shirt and considering they are locking up people for having sandwiches (I can't believe that they are honestly going to such lengths) I want my wife home and safe, I called IAD today and the girl on the phone was giggling and laughing as she said well you have to wait another month and a 1/2 for the file to be transferred as apparently it's gone from the 90 days it said on the initial letter they sent me to 120 days to mail some paper from Singapore to Canada I though 90 days was absurd but they just added another month. She was kind enough to laugh and giggle as she said you won't likely have a court date until after march 2015 as they are now scheduling September and are processing a back log.

Has anyone had luck with a TRV while they were waiting? Is there a suggested process? The Lousy 2 weeks a year I'm graced with for vacation to see my wife is far from enough each year we've jumped though CIC's hoops barked when they asked did everything they wanted played with them only to be kicked in the face and left at the curb. There is a serious issue with Canadian immigration and discrimination of human rights that desperately needs to be attended to.

I really don't care what kind of restrictions they want to place on her visit as long as She can be here even if it's only for a month or 2 or 3 the instability in Thailand is very worry some.

There's absolutely nothing stopping your wife from applying for a TRV. She would follow the standard TRV application process - there is unfortunately no special / separate process for individuals in her situation.

Unfortunately I think the chances of her being approved are slim to none (given the refused PR application and appeal in process).

But again, you can always give it a shot...

The refusal reasons
1. she's been married 2x first was a shotgun wedding she didn't want (had to save face of family) 2nd was a foreign national who told her to sign paperwork to extend her "vacation" the paperwork was in another language. He did support her family during this period years ago and divorced all paperwork in order

2. She chose to speak in Thai for her interview as she didn't want any confusion they decided that she couldn't speak English and obviously me and her don't actually talk to each other.

3. She's 5 years older than me

I'm sorry, but 5 years should not have been a factor. I do not know what is wrong with CIC sometimes. The second is a fairly common reason - if the couple don't share a language, the visa will probably be refused. At the appeal, she can still use an interpreter, but clearly explain it is because you don't want any confusion, and clearly stress that she can in fact speak English. If she has taken any English classes or tests, submit these results as well.
To get a TRV, she has to prove ties to Thailand stronger than her ties to Canada. A letter from her boss giving her a few weeks off and saying that she is expected back would help. Leaving a child behind will help. Any property and bank accounts or investments will help. Unfortunately, Thai nationals have a hard time getting TRVs, and someone with an appeal will have an even harder time.
If she has a lot of evidence of ties to Thailand, and they still refuse her a TRV, you can appeal that decision at the Federal Court level. I've seen one that won.

I think the first two are the biggest red flags, the 5 years age difference shouldn't be a big deal. They probably thought because she married a foreigner before, and now she's doing it again, that means she wants to marry to leave Thailand.

I think the TRV will be impossible to get, especially after her PR is refused. Also, I think the situation in Thailand doesn't seem as bad as it looks on the news, according to my friend who lives there. He says the military junta lifted the curfew, and they really only arrest people if they're doing silent protests or what not. Despite the military rule, people still live their lives normally. As long as she just keeps a low profile she should be ok, her life isn't really in any danger, if she was in Iraq or Syria right now, that'd be a different story.

Unfortunately getting TRV for her would be a miracle but there is no harm in trying. It could be even a plus point for the appeal. Let her submit TRV application with solid documentation proving strong ties to her country. The red flags which they pointed out must be addressed and handled professionally preferably by an experienced lawyer or consultant. Because those are really big issues for CIC. Good luck!
