Is consent form required while applying for GCMS Notes

Hi Yahoo7....This was a contentious topic couple of months ago.

I had applied 4 times for my GCMS and not once did I need to provide consent form for my spouse. There was another member in this forum who had indicated that he/she was required to (and, in fact got extremely irritated and alleged that I was passing wrong information.)

Now, as far as I am aware if you are asking the notes for yourself (and, there is a question in the form that asks you that....are you requesting info on your behalf?), you dont have to submit a consent form. Your spouse's and child's (if you have any; I had 1) information will be automatically included in your GCMS notes (thats how I received mine) as you are the principal applicant and their applications are connected to you.

As a response to your inquiry, please note that if you wish to receive information for both you and your wife, it is recommended that you both sign consent forms showing that consent has been given to the individual you have appointed as you designated representative.

However, when you are applying for yourself (not through a representative) then I dont believe that your spouse (and I have NEVER send my spouse's consent) has to sign a consent form.

Now, yahoo7 ..............are you requesting for GCMS on your own or are you asking a representative to do it?

That is why I have mentioned in my previous post the question - are you requesting on your behalf? - if the answer to this question is yes, then you do not need a consent form signed by your spouse

But if, you are applying through a representative/friend/relative, then 1) you cannot answer "yes" to this question and, 2) you have to send a consent form signed by you and your spouse

I am requesting for notes on my own behalf and also for my spouse. Should I just mark yes for the question which says "are you requesting on your behalf?"? and attach the consent form from my spouse in the documents section?

Or should I place 2 requests, one for myself and one for my spouse?

Please help...

I have asked similar question a few months back and did what some of the forum members suggested me. This is my experience-
I marked "yes" for "requesting on your behalf" and have not attached any consent form for my spouse . The GCMS notes which I received in approx 30 days had information about me and my spouse. [I made just 1 request]

Thanks cec007..i will wait and see of I get any reply to my email to cic and accordingly order one more notes by attaching the consent form from my spouse

The mystery has been solved now. Just got a reply from ATIP client service representative and this is what they said...

"We require your spouse’s consent in order to be able to release the whole file. You may submit a new request with your spouse’s consent."

pckumar, Correct, even if I requested my notes on July 12, it was only generated on July 31 and I could not find any answers at the end of notes related to criminality or my spouse medicals. I am going ahead and placing a new request and was just waiting for an answer from them.

Well, that just answers your question...........if they have asked you to do it, you HAVE to do it.
