is canadian spouse/sponsor included in additional family, form 5406?

Hi guys, thanks for this forum, I am the sponsoring wife, and we are wondering if I am to be included in form 5406 under "additional family info"

also I have kids in Canada, technically they are his stepkids, but does the form want stepkids in Canada, who are the kids of the sponsor?

Yes you list the applicant and spouse (sponsor) in the additional family form. You also list the applicant's stepsons as well even though they are living in Canada even if they are Canadians. List all the applicants dependents including step sons since they are technincally adopted sons. The forms says list all natural and/or adopted dependants. So the question is this. Do stepsons fall into the adopted dependents? That I cannot say wíth certainty.

I think it is best that someone in same situation as yours would better answer the question. But your spouses must be on the addition family form.

I just confirm it in the guide. Dependents include step child. So the applicant must list his step sons.

For reference : stepchildren are not considered as adopted until a formal adoption process is completed. The new step parent does not acquire the parental rights from the biological parent just by marrying the other parent.

The sponsor is definitely to be included on the form 5406 as the spouse.

The children of the sponsor? You could argue no. I would list them anyway, since it will not hurt to include them even if it was not necessary.

Techincally this is true. However there are cases whereby the new step parent did end up paying child support for the step children in divorce courts. The court did say that by marrying, you are accepting responsibility of the step children as your own. They said you can divorce your spouse, but you can't divorce your children, step or otherwise.
