IRCC Refusal Letter for CEC - NOC Mismatch

Hi everyone,

I recently received a refusal letter for my Canadian Experience Class (CEC) Express Entry application, and I’m looking for advice or insight from anyone who has been in a similar situation.

Background:

• My CRS score was 511, which was above the cutoff for the draw I was invited and got AOR August 22/2024

• IRCC refused my application because they were not satisfied that my job duties matched the NOC code I provided.

• My role is titled “Administrative Assistant” (NOC 13110), and I submitted supporting documents like a job letter, T4, NOA, and bank statements.

• After reviewing the documents and conducting an interview, the officer decided the NOC code didn’t align with the duties described in my job letter.

Key Concerns:

1. Should I challenge this decision through a judicial review or mandamus with the help of a lawyer?

2. Would it be better to correct the NOC issue and wait for the next draw to reapply?

3. Has anyone else faced similar refusals for NOC mismatch? If yes, how did you address it?

• I have two years of Canadian work experience under the claimed NOC.
• My duties include project scheduling, document management, and team coordination, which I believed aligned with the selected NOC.

During the phone interview, I explained my responsibilities, but it seems the officer felt they didn’t match the NOC’s job description.

I’d appreciate any advice, suggestions, or similar experiences that could guide me on how to proceed. Thank you in advance for your help!

You need to get a consultation with a lawyer to go through the details of your case.

Sorry to hear that.

Have you submitted the reference letter in addition to your job letter detailing all your duties?

That should be in align with the lead statement about 70% of the main duties as well.

Lawyer or a IRCC licensed consultant would be the right person for you to proceed further. All the best

Your job tittle doesn't matter much as your duites. Thu reference letter must prove that your duties are aligned with the lead statement and the duties which are mentioned in the NOC description.

And yes, you cannot do anything but wait for a new ITA and apply again.

Judicial reviews, mandamus and the like are not applicable here.
