I have a friend who came from Pakistan 3 months ago on a student visa to Canada. Her entire process has been under the guidance of her "consultant" who works in a Pakistani board of tourism office.

After the guidance she has received from this consultant, it seems to be her visa might potentially be invalid. The consultant suggested she move provinces and begin working to have more money for college (the consultant said that the money she was bringing from Pakistan would be enough, and it IS NOT ENOUGH). The past few months she has been working full time to save for university.

Obviously now with research it seems this will invalidate her visa...

What can she do now??!!! Please help.

Various consultants and lawyers have suggested for her to file for asylum(refugee), others tell her to apply for a visitor or work visas, and another says to reapply for a student visa. There is no clear guidance.

She has spent her 33 years of life in Pakistan and her knowledge of this immigration is limited, so she is at the mercy of all these "consultants".

It is agonizing seeing her worry, and I'm asking advice on what can she do to be in Canada LEGALLY.

I truly appreciate legitimate advice
 
Others can comment as well this is my view but first she must stop working immediately given working whilst not enrolled in a college/university or on a scheduled break is illegal.

Not really clear how she arrived on a student visa if she was not enrolled in any institution and in any case if she has been in Canada for 3 months already then is likely her student visa has been cancelled for non attendance.

What reasons does she think she has an asylum claim , is her life in danger in her home country ?

Others can comment as well but seems to me the only option before things get more out of control what with working illegally and at some point overstaying would be to just pack up and go home.

Seems unlikely that there may be any other option to stay given her lack of access to financial resources to even think about applying to a college with a new permit if that were an option. Without financial resources applying to stay on as a visitor makes no sense and although no background information seems unlikely applying for PR could be an option. A work permit requires an employer to support an LMIA which is almost an impossible option to achieve.

Unfortunately seems a clear case of someone putting their trust in a consultant who seems has absolutely no idea about the process involved and should be avoided at all costs.

She had an acceptance letter and admision forms from a university she wanted to attend.

The Asylum was advised to her by some lawyer (I believe it was him just wanting money to file the documentation).

And she has had suffered from sever domestic violence within her home. Note sure if that is relevant.

But is it possible for her to reapply for another student visa? Will it be allowed even if she has a current invalid visa?
 
She probably needs to consult an immigration lawyer in Canada rather than a public forum given her situation and her current status in the country . Nobody here is a professional and only expresses personal views which in her specific case are not really sufficient hence need professional advice. Note though not any consultant in India and certainly not the tourism board employee.
 
I truly appreciate both of you, I'm here because she had spoken to various lawyers in Canada who have all given her different forms of advice and suggestions. There seems to be little to no clarity.
