International Experience Canada-> Implied status-> LMO

Hi,

I'm in Canada on Working Holidays I have open work permit.
My employer applyed for LMO but my work permit expire in two months.
Can I apply for new work permit before my old one expired and gain "Implied Status" based on LMO appication?. (Because I Implied not benefit from working holiday program)

Do someone knows what means this red statement?

* Participants in international youth exchange programs (e.g., Student Work Abroad Program (SWAP), International Experience Canada (IEC) or Working Holiday Program (WHP)) do not benefit from implied status, unless extending a work permit not initially issued for the time limit authorized by the program.

There's no implied status for IEC. So if your new work permit isn't approved before your IEC expires, you will have to stop working until the new work permit is received.

What the statement in red means is the following: Let's say you were on an IEC visa for a year. Before it ended, your employer obtain an approved LMO and you obtained a new work permit. Let's say now that the second (non IEC) work permit is now near expiry. You have applied for a new (third) work permit but the new (third) work permit won't be recieved before the old work permit expires. In this case you have implied status because you applied for the third (non-IEC) work permit before the second (non-IEC) work permit expired. However since you're going from IEC to non-IEC you don't benefit from implied status.

I called to CIC and they say me that if my employer apply for LMO I can get Implied Status even if I'm now on ICE OWP.

Find for an employers who are willing to go through LMO process...Or apply IEC program again. You better shift to Visitors Visa after your IEC visa expires, so you will not get out of status...

Why do some people say that Implied Status doesn't work for IEC Visas? Does anyone has written proof? I keep calling CIC and they tell me that I can get Implied Status after a WHV if I apply for a Work Permit with LMO for example. I told them to send me a letter with this information but it seems like it is not written anywhere.

So that is why i wanna know why some people are so sure that you cannot get Implied Status with a IEC visa?

If you look through the old threads on this topic you'll see written proof from CIC confirming there is no implied status for IEC. The call centre has a tendency to give out wrong information for all but the most basic questions. For example, several people have been told you can't apply outland while in Canada. Extremely basic question (way more basic than implied status) - very very wrong answer.

The other proof we have seen is:

1) The person who received their PR visa but was then refused landing at the border due to illegal work (working after their IEC expired because they mistakenly thought they had implied status).

2) The person whose inland application was transferred to the local office for further examination and didn't receive AIP again due to illegal work (once again, thinking their was implied status with IECs).

CIC was very clear in both of the above cases that implied status does not apply for IEC. And keep in mind that these are the people making decisions about your file - not the call centre staff.

Ultimately it's your call.

No one gets implied status when applying outland (regardless of the type of work permit they are on). Implied status is available for inland applications only (and only for certain types of work permits).

If a lawyer told you that applying outland gives someone implied status then you should run in the opposite direction because that lawyer has absolutely no idea what he's talking about and is going to mess up your life.
