I applied for Canadian Experience Class, I studied for 5 years in Ottawa, and worked there for 2 years.
After the COVID, I moved to Montreal, in April 2020 after losing my job due to the COVID crisis.
I did my first application for express entry from Quebec, I knew I was not eligible so I canceled it.
In June, I decided to go back to Ottawa, so I applied for Express Entry in June 2021. I had a lease and a Job in Montreal QC.
After speaking to a lawyer, he said that I can apply to express entry from Montreal with an intention to move to Ottawa after receiving my PR. (the time of processing was around 6 month) so It would be around November/December. I didn't renew my lease knowing that I was moving to Ottawa. (I have the proof)
The IRCC agent didn't see it from the same angle as the lawyer, he sent a procedural equity saying that he had no evidence that I was moving to Ottawa.
From the Ontario official website, this is the point of the intent of living in Ontario:
1 - Working or having worked in Ontario:
I showed that I have worked 2 years in Ontario (in the application) and joined a letter that my work is allowing me to work remotely.
2 - getting job offers or applying/interviewing for jobs:
Showed the proof that I was applying at jobs all across Canada (since june and before june) my job is in Montreal.
But keep in mind the residency and work is not the same.
3 - Studying:
Studied 5years in Ottawa, even got my pre primary school over there.
4 - leasing or owning property:
Joined a proof that my lease in Montreal is done and a new lease starting on November (8 month leases) And also a lease, that my mother owns a condo in ottawa and she's willing to let me live over there at any time when needed.
Also proof of changing address of billing of my phone and bank accounts, and applied for health card.
Also, 2 days before receiving the letter, I sent a message saying that I changed address and supplied a temporary address before moving to ottawa. through a web formular.
5- having professional networks and affiliations, family ties and personal relationships:
Linked a number of people that I know and have affiliation like close friends, past managers, and my brother.
Also, since it's a human at the other end, I wrote a letter explaining what I first understood, what happened with my job, and that I have a special attachment to Ottawa.
