Hi all,

I am planning to apply to Super visa for parents,

I have confusiong on how to calculate family size,

my family status at the moment is divorced, (ex-wife plus 3 kids under 18).

so, would my family size be 3 ( Myself + 2 parents )

OR

7 ( Myself+ 2 Parents + ex + 3 kids )

please note that my Ex and kids dont have any status in Canada since divorce happened before completion of Family sponsorship ,and I have a Canadian citizenship.

thanks

If you are divorced, you don’t count your wife. So are your children dependant and under 22? Are they not part of your sponsorship application? If under 22, count your children so 6 people.

Yes, I am divorced,

My kids are under 22 but they dont have residency status in Canada, neither my Ex-wife.

The number of people is 6 for family size (you + your three minor children + your parents).

So you haven’t applied for their sponsorship?

I did but divorce happened during the sponsorship process so I canceled the application.
and I dont have any sponsorship right now.
EX-wife and kids are outside of Canada with no status here and EX-Wife have custody over kids as they are minors.

Even if kids are outside of Canada and have no status in Canada.

Ex-wife have custody over the 3 kids.

can you please direct me to a IRCC reference where it elaborates about family size

If your children are your dependents and are under 22 they count in your family size because you can sponsor them at any time not to mention you should be providing financial support to them. A supervisa partially considers your financial obligations to your family. Just because your ex-wife has custody of your children and they don't live in Canada that doesn't mean you aren't responsible to provide for them.
