Inland sponsorship: An option to sponsor a spouse who is already in Canada on visitor or another visa. It is processed completely in Canada but does have a couple of drawbacks such as longer processing time as well as not being advised to leave Canada while it's in process as well as sometimes having complications adding a couple of years to the processing.

Outland sponsorship: All other sponsorships. Outland sponsorship stays in Canada only for the part to approve the sponsor and then the rest of it is processed in the sponsored persons country of nationality or residence. The only downside with outland is that if you are called for an interview, you will have to go to the processing country for it.

It's a common misconception that you have to sponsor inland if your spouse is already in Canada. You don't.

Hi Leon, Thanks for your reply as I am in similar situation. I have a question: If the sponsored spouse is in Canada with a visitor visa for 6 months and the Inland processing takes more than 6 months, what happens to the spouse's legal stay in canada? Does the spouse must leave Canada with in the 6 months period or is there any way to extend the stay or visa legally inside Canada? Is there any provision to extend the stay on a visitor visa legally with going outside of Canada? Thanks in advance.

If you apply inland, there is a requirement that you are in Canada. It is not advised to leave Canada while the application is being processed. If you do, and this has happened to some people, it's possible that you can't get back in, happens sometimes, especially if you are not visa exempt and in the case this happens, the inland application goes out the window since you are no longer in Canada and all the time you spent waiting for it is for nothing.

Somebody who is applying inland should send a visit status extension request as well as a request for open work permit to be granted on first stage approval. They should send this in one package along with their sponsorship and PR paperwork. Whether you are applying inland or outland, if you are staying in Canada, you should always make sure that you have legal status. You can apply for a visit visa extension at any time before your visit visa expires. If you let it expire, you still have 90 days to apply for restoration of status. If you have applied and not heard back yet, you have implied status until you get an answer. They will not kick you out while doing inland. They could kick you out if you are doing outland but it would not be a big deal since with outland, your application continues on and gets processed, you get your PR and come back.

Hi Leon

If the PR application is being processed outland and my wife is with me in Canada, would it be possible to extend her TRV in Alberta Canada for a year quoting that the PR application is being processed in that country? We will be getting married in Canada next month, so she will be entering Canada as a visitor - is it OK to tell the Immigration officer that she is visiting Canada to get married or should she just say that she's visiting her boyfriend?

Also, for outland applications, Can I request for an initial open work permit? To request for an open work permit, is it required to have an offer of employment?

She can apply for a TRV extension a month before her time is up but it's not guaranteed that she will get it.

It would be safer to tell immigration that she's coming to visit her boyfriend. They do not have to let somebody in if they think they are a risk of overstaying and coming to get married doesn't exactly make it sound like she's planning on going back home afterwards.

She is not entitled to an open work permit. If you applied inland, she could get an open work permit at first stage approval but usually by the time that happens, had you applied outland, she'd already have her PR.

Thanks Leon, another question. Can we start collecting the Police Certificate and Medical Certificate now before we are actually married in preparation for the PR application process so that when we actually get married, I can file the application the next week itself?

You can but be careful that the police certificates can not be older than 3 months when you apply and the medical is valid for a year so if your medical expires during the time of processing, it will have to be re-done.
