Hi everyone,

I'm new to this thread. We are planning of submitting my husband application next month. We just got married in April(Marriage Certificate is out) this year after dated for 8months. Im PR have been here for 13years originally from congo. My husband moved to Canada as an international student from Nigerian just in May 2016 then we met in August 2016, after dated for couple of months we finally was officially married in April 2017.

We have all the proves of our relationship and wedding pictures with all my family members present except that his family members are all back home and couldn't make it but they did had a get together and send us photos too. He also had to fly from Winipeg 5times to visit me during the time we were dating because I lived in Victoria BC (Different province.) We have all air ticket recipts for his visit as prove as well.

He pause his school and finally moved to Victoria because of the nice weather we have here and I also have my job here too. We are working on him transfering few courses he took in winnipeg to any school here and finish up when he gets his papers or before then anyone that works for us.

And we also thinking if it is possible to apply for open work permit so he can work full-time save up and go back to school after his PR is approved or go to school same thing but not sure if he will still be allowed to continue his school with open work permit and his study permit will expire in 2019.

We are currently living together happly and he got a part time job here while im working full time. We plan submitting our application next month and look forward to getting all the advice we need on how to go about it in here thanks☺

It sounds like he's currently not in school?? If that's the case, then if he's working even part time he could be doing so illegally. Working part time with a study permit requires you to be a full time student. http://www.cic.gc.ca/english/study/work-offcampus.asp

As long as he has legal status in Canada and you continue living together, then he can submit an OWP app along with the inland PR app. He would get the OWP approx 3-4 months later. I don't think this would interfere with his study permit.

Not only is he currently working illegally, but seeing as he's been out of school for now 7+ months it seems he is most likely without status so illegal in Canada now. Once he quit his studies, the school may have reported this to IRCC after which time his study permit would have been cancelled.

If this is the case, then even applying for OWP with an inland PR app may not work since the OWP requires the applicant to have legal status when applied for. So you really need to confirm if he has any status right now, and if not it will present many difficulties with the PR app as well as wanting to attend school in the future.

Not to mention if it's discovered he's working illegally, he could be deported from Canada and given at least a 1 year ban.

It is ok he takes some time off school. He just need to let his school know if hes planning taking more than 2 semesters off.
Also, you should download adobe reader. That will help you to download all the documents you need from the CIC website.

Finally, since your application is inland, i will suggest you join this forum. You will get help faster and also there are more cases like yours in the forum you can use as FYI during your process.

Rob is correct. He is most likely without status and is definitely working illegally. He must stop working immediately. Summer break is not "taking time off"; it is considered a scheduled break in the academic year. This is entirely different than what your husband has done, which is simply stop studying in the middle of the academic year, thus violating the terms of his study permit.

Okay Rob, we are submitting his application this month. Have all the forms downloaded including OWP. We hope things turn out well for us. I wanted to know if we are not using the representative we don't need to fill out use of Representative form right? Is there any means of making payment aside from online payments?

Hello

I recently got married in Pakistan my husband is a Canadian and I am on a TRV worker permit.
We both are in Canada now and living together, We want to start out in land sponsorship + PR Process.
According to the new guidelines, I still am confused on what documents are required from Pakistan?
I Know that i have to provide Nikah Nama, Nadra family registration cert, Nicop, Birth Cert and Police Clearance. Other than that what else is required? Do i need to get all these docs attested from a foreign ministry? If yes, can they be attested from Canada?

Also, is it better if we dont show the Pak wedding at all and get married here? We recently got a marriage license so should we get married here as well?
