hi,my husband is Canadian citizen we've been together since 2008 but get married 2015 and we have a daughter born here.we applied last 2015 for spousal sponsorship but disapproved because there was a case between him and his ex wife because of alimony.the judge final decision went down last Feb 2017, but the alimony will last until may of 2020.is it possible to reapply while the alimony is not yet done or
we have to wait until the alimony his paying is totally done.your comments are all appreciated, Thanks

From the guide:
You can’t be a sponsor if you:

  • have failed to pay:
    • an immigration loan
    • a performance bond
    • family support payments
He may have been considered behind in payments because it was an open case. I would try again now that it is settled. Just make sure he is up to date.

If the divorce has been finalized and your spouse has paid court-ordered alimony or child support up till date, has resolved the family support matter and does not default in payment........i think your spouse should be able to sponsor.

Its very important that your spouse always pays and should not default in payment especially while the sponsorship is been processed.

You may not be able to sponsor if you…

  • signed an undertaking for a previous spouse or partner and it hasn’t been three years since they became a permanent resident,
  • receive social assistance for a reason other than disability,
  • previously sponsored someone and did not pay back any social assistance that they received while the undertaking was in place.
  • are in default on an immigration loan or a performance bond
  • did not pay court-ordered alimony or child support
