Since he submitted an OWP with application, he had "implied status" as a visitor until OWP is approved. He was never out of status when his visa stay expired.

He would be eligible for the OWP under the new pilot program. He would have to wait up to 4 months after sponsor received AOR though. Not after CIC received it.

are you sure that's the rule? i thought AOR and OWP were going to be issued together in "4 months"?

At this point, march is really the earliest we will find out what the deal really is.

I am only going by what other senior members have said and posted, which to me makes sense. OWP is processed in vegreville so until CIC-M input the application and makes an official AOR, only then does CIC-V is aware of the application being in the system. Then CIC-V can issue an OWP within 4 month of receiving the official inputted data in the system, which is after AOR.

oh geez. that certainly does make sense. i hope they start doing aor's quicker then, because right now it's going on 4 months i believe, so that would mean the OWP wait time could really be 8 months? i just hope more people don't get stuck in the inland stream because of it. unfortunately, i think many will...i guess we will have to wait to see what happens.

OWPs are being issued like crazy. They have issued up until June 2014 files today. :eek: Half a year of backlog in a week or something OMG

right, the truth is though for NEW applicants as of Dec 22, we don't know if the new OWP will be issued "4 months" from date the application was received or "4 months" from when AOR is received. those are 2 very different timelines. we aren't questioning the backlog OWP. unfortunately, there are a lot of new applicants taking the bait of this new program without knowing what will actually happen. it's a huge risk for visa exempt applicants in my opinion and isn't a reason to apply inland instead of outland.

Lets hope the existing inventory continues to be cleared at this pace next week so the applications submitted after dec 22 will then get looked at quickly!

I have one more question though, when we were filing out form IMM 0008 question 10, it asks country of residence, status (ie, visitor, refugee, and so on) then its asks from date and to date. I don't know what to put here because he is out of status and still waiting for he visa ext.

anyone have any advice?

Chris he is not out of status, as you applied for an extension he has 'implied status' therefore he still is a valid visitor in Canada. CIC will either decide to extend his visitor visa or very unlikely refuse it. Until you hear from them he continues under the same visitor status as before.

thank you for the info, but no one has answered my question, if any can give me some advice.
As I am going to be sending the inland application hopefully today. What should I put as to when he has his visitor visa until? I understand that he has implied status, but his actual visa expired Dec 17,2014.
I cannot put this date on the application since it has already passed. Should I write a letter explaining the situation, or should I call them to see if his extension was approved? Will they give me that info over the phone?
