Hello everyone
I m PR and planning to sponsor my common-law partner. He is on PGWP, working in Canada and his permit expires this year
Thus, my question is while submitting the sponsorship application, can he apply to extend/get a new open work permit so that he can continue his job?

Thank you!

Yes. The Inland application along with an OWP application will give him Maintained Status during the PR sponsorship process. This must be received by IRCC prior to his PGWP expiry (the sooner the better, actually).

If he doesn't receive the OWP before his PGWP expires, I don't believe that he can work until it does arrive, because the PGWP is not an extendible type of WP (unless that's changed). He would have `Maintained Status' (formerly Implied Status) but only as a visitor...I believe. Better to wait for at least one more opinion. LOL!

But, maybe this will be useful info...and could save the $$ applying for an OWP?

Any one else would give me an idea on this?
“while submitting the sponsorship application, he will apply to extend/get a new open work permit so that he can continue his job. His PGWP expires in 3 months
After 3 months, can he still work with implied status if we already submitted OWP application?
Thank you

Of his PGWP expires in 3 months won't this be a better option to extend his work permit. You can still submit OWP if you want.

https://www.canada.ca/en/immigratio...ary-resident-permanent-resident-pathways.html

Open work permits for individuals with expired or expiring post-graduation work permits

Foreign nationals whose post-graduation work permit expired or will expire from September 20, 2021, to December 31, 2022, will have the opportunity to work in Canada for an additional 18 months by either extending their work permit or applying for a new one. Those currently in Canada will also have the ability to work in the interim period while their permit is being extended or a new one is being issued.

He applied for PGWP 18months extension last year
Do you think he is eligible for this again?

Oh. Sorry. I didn't know that he already applied for extension. Then it's better to apply for OWP with your sponsorship application.
Make sure that the application is correct and complete so that he gets his implied status.

The answer is no according to the details now available. Those who previously benefitted from the 18 month extension do not qualify for a second one.

Thank you Scylla
So after submitting the OWP (along with sponsorship application), can he still work on implied status even if the current PGWP expired and final decision on new OWP hasn’t been made?

Wrong thread to be asking that question. Maybe create a new one?
