Inland Sponsorship and Open work permit

Hi,
I am a Canadian Citizen and my almost husband (getting married in a month in Canada) is from Pakistan but in Canada. He had a work permit and was working for past 3 years. However, his work permit expired Sept 6 and was not renewed. He had applied for OINP back in February 2016 but still hasn't gotten the approvals yet for that. I will be sponsoring him via an inland sponsorship applicaiton. His status is now from worker to visitor, he has had to applied for visitor status now that his work permit has expired.

We will apply for sponsorship and OPW simultaneously, does anyone know how soon after we apply can he start working? will he have to wait till the work permit is approved? or can he start work after he applies due to implied status? My understanding was that there would be no implied status since his work permit expired?

Can anyone confirm?

He'll have to wait until he gets the OWP to start working. I think that should be around 4 months.

Did he apply for the visitor status before his WP expired? If he did NOT, he is now out of status and needs to apply for Restoration of Status within 90 days from the day that his WP expired.


If he did...

If the application to change his status to visitor is denied, he would not qualify for the OWP. He would then need to apply for Restoration of Status and then submit the OWP if the ROS is approved.

He then had 90 days after that to change his status so he applied for visitor visa after that. If we do the sponsorship application during a valid visitor status, will he get implied status then to work? or will he have to wait until the OWP gets approved?

He is currently out of status and needs to apply for Restoration of Status as a visitor.

As he is out of status right now, he doesn't qualify for the OWP.

Thanks for your quick responses, we will apply for the OWP with the inland sponsorship application after his status is restored as a visitor. I just wanted to know how soon he can start to work again.

Well, if the ROS is approved...it will be ~ 4 months after CIC receives the Inland application and OWP before he will be eligible to work again.
