Hello everyone,

I will be sponsoring my wife via the inland method shortly for PR. She currently is working in Canada on a closed work permit which expires end of 2014. She is from Indonesia, so the processing time is close to 20 months.

I understand that it's possible to receive an open work permit after the first stage of the PR process. One of my questions is, is it possible to receive an open work permit while she already has a closed work permit currently? How long is the open work permit valid for?

What happens if the PR process takes longer than her current work permit allows (which is until the end of 2014)?

Basically, we want to make sure that she can continue working as long as the PR process is taking place instead of switching her status to a visitor.

Inland apps are around 14 months right now. Have a look here http://www.cic.gc.ca/english/information/times/perm-fc.asp

Yes, she can apply for the OWP while on her closed WP. The OWP is valid until you guys receive a decision on the PR app, so it doesn't matter if the app goes beyond expiry of the closed WP because she will be on the valid OWP.

Can someone here clarify it?

Also on OWP application form which is the generic workpermit, should I specify LMO and Employer detailed info?

Hi

He doesn't actually say they should be sent separately, he just says it's possible. That thread is almost 3 years and it was not as well known then that you could send the OWP with the inland PR app, so there were people sending the OWP app after already submitting the PR app.

However, it is MUCH BETTER to send them together; because the OWP app is only processed after sponsor approval, the 2 apps would have to be matched up anyways if they were sent separately. Sending them separately runs the risk of the apps not being matched up, in which case the OWP would be denied.

There is no need to put LMO or employer information, as you are applying for an open work permit.

Because it is actually an OWP app, it doesn't really matter which one she chooses. I would pick the second option, "Work permit for new employer". But she DOESN'T actually fill in any employer details; leave the employer and LMO section blank. Across the top of the form, write something like "OWP for inland spousal PR application".

Make sure you send the open work permit application with the sponsorship to Vegreville, Once they receive it your partner can work with her current employer until she receives the open work permit... She will be on implied status and its doesn't matter if her closed work permit expires she can still work with the same employer and she will still have legal status in Canada.

I have a question if anyone knows the answer to this. We are also applying Inland PR. When my husband receives his OWP does this give hime status in canada?? And could he travel and get back into Canada with an OWP?

Yes, it will give his status. However, work permits specifically state "This does not authorize re-entry"; the permit allows him to work in Canada but it has nothing to do with actually being allowed to enter Canada. A border officer can turn away a person even if they have a work permit. With an inland app, he shouldn't leave at all; if he is denied re-entry, his app will be cancelled.
