Hi everyone,

I am a British citizen and my girlfriend is Canadian, we have been living and working together in South Korea since January 2017, and will continue to do so until November 2017 when our contracts run out, that means that we will have lived together for a 10 month period.

After our contracts are complete, we are both planning on flying back to the UK to live with my parents for a few months, before finally heading to Canada on a permanent basis.

Once we have lived in the UK for two months, we would have lived together for a total of 1 year, which means that we would qualify for the common-law sponsorship.

We have evidence of us living together here in South Korea, and we have met each of our families in person too in various countries, and we have been on many holidays and excursions always together, all of which we have copious amounts of evidence for.

My question is: would it be best to apply for common-law sponsorship from the UK when we visit this winter, or when we get to Canada later on? Also, if we did choose the UK option, would I be able to work whilst in Canada?

Thanks for your help.

For the 12 continuous months qualifying, just make sure there is no break in cohabitation between Korea and UK. So as long as you are always travelling together, it should be fine. Also make sure you get proofs of cohabitation for the final 2 months in UK. You and your parents can write up a simple rental agreement and get it notarized, plus see if you can get any joint accounts while in UK, or make sure something is mailed to both of you at your parents address.

If you apply OUTLAND for PR while in UK, there is no OWP associated with this. So you could come to Canada as a visitor while processing, but can't work until you get PR approved.
If you wait until you get to Canada then apply INLAND, you can submit OWP at same time and would get it approx 3-4 months later.

Typically outland apps from UK are much quicker processing then inland, so would most likely get PR status much quicker.

Thanks for your response! Very informative. Good news regarding my parent's address for sure.

How long does a PR application take to process from the UK office?

Thanks again!
