;D :D @ Nahmed. You wouldnt get AIP if your file was transferred. AIP means that you and your spouse are eligible to sponsor and be sponsored. So you just need to send in your OWP as soon as possible

You got AIP so your file is still in Vegreville till they finalize your application, You should send an open work permit application complete with the requirements and your previous receipt and a copy of the AIP Email. It might take you 2 months to get the open work permit so I suggest you do it now.

Tnx for the info Karito, unfortunately a lot of us are on implied status, so even do we are legally working or studying or just staying at home in Canada without a valid visa if you leave the country the process will be cancelled!

I was told this by the CIC a few weeks my visa expired so I was lucky enough to have a few unused vacation days at work plus my travel discounts (working for an airline) and was able to fly and see my family before my visa expired!!

It looks that everything is going well for everyone so fast! Im pretty sure you will get your PR soon!!! ... Im still a few months away from that :(

Fortunately No File transfer. I got AIP and open work permit already exactly 6 months of sending the application.

I will do that, as soon as I get a reply from technical department that there is no other option but this.
because I stressed on the fact that I have already waiter 2 months for the bloody work permit and they loosing an online application
is not my fault! its their...

So they need to either find previous application or process my new one on urgent basis....
its ridiculous... ;D

Can i sponsor my spouse as an inland applicant even if she is canada on a visitor visa? or do i have to apply as an outland applicant only?

I am thinking of bringing my spouse to canada on a visitor visa and then file for her sponsorship as an inland application. - Only reason is so that we can be together here in canada while she waits for her PR rather than being in different countries.

Your response would be much appreciated

Yes you can sponsor her inland or outland, if you do inland make sure you send an open work permit application with the sponsorship this way she gets implied status, or extend her visitors visa if you want to be on the safe side. If you choose inland its best she doesn't leave the country till the process is over. Good luck.
 
Hey Scorpion! Yes you can do that with no problem. You can also have your spouse apply as an outland applicant too, and your spouse can wait out the time in Canada too. However, if your partner is not from a visa exempt nation it can be hard to obtain a visitor visa without being able to demonstrate strong ties to their nation of residence. One of the experts can tell you more about that!

In a nutshell, the differences between inland and outland are as follows.

Inland - Takes around 18 months all in from application to PR. The applicant can apply for an open work permit at the time of applying, which will be granted should you gain first stage approval (which I believe is about 6 months though one of the inlanders can let you know!). Please bear in mind though, that applying Inland gives you NO RIGHT OF APPEAL, so if you are not 100% in your application please be careful!

Outland - Processing time varies depending on the High Commission/Embassy processing the application. (The list is here. http://www.cic.gc.ca/english/information/times/perm/fc-spouses.asp ) There is not a Open Work Permit option here, but the processing time can be significantly shorter. You also have the right to appeal if things don't go your way, and you spouse can remain with you in Canada while the PR processes (though depending on circumstances, you may have trouble with the original visa).

So, food for though! Either way though, your partner can be with you throughout the process, provided they can gain entry to Canada in the first place as a visitor!

I know CIC says 8 months for stage 2, but from reading the timelines on this thread, it seems like it's actually only 5 months now. Beware though, the waiting time might jump up. The total time (stage 1 + stage 2) was 19 months last year when I applied. :'(

Really appreciate your quick response. My wife is from India and i am sure she would need a visitor visa. She has already applied for it and is now eagerly waiting to hear back from the embassy.

Yep I agree, Generally at this time its 6 months for 1st stage and 5 months for 2nd stage. Hope this trend continues, the processing times are so unpredictable.

I know how it feels , it's been over 2 years I haven't seen my family , unfortunately there's no flight direct from Vancouver to Ecuador at work I only could take one week that's why I just went to Mexico nice thou :), and yes they always advise do not leave the country during the process but in wondering how muh of that its true. I did my research before leaving and didn't find anybody who was denied the entry, well when you have all the documentation. I don't think will be an issue.
