Hello my friends,

Need your help urgently!!

My wife got her AIP letter from CIC today. She wants to apply for an OWP (open work permit) because the letter says she is now eligible for it. She was applying online but then got stuck because a message tells her that her visitor's visa expired over 90 days ago and therefore she cannot apply for a work permit.

Anybody knows what this is about and what we should do? She really wants to start working asap. Thanks a lot for help in advance.

Hi Babyhangon.
Firstly, please send your wife my biggest of congrats and to you as well. What date was her previous status dated up to? I believe it might be wise to try and contact CIC about it. However, if you are out of status, the last I read just because you get AIP doesn't technically put you into any status. Of course as I am sure as you know now the best would have been to submit the OWP with the application before her status expired. You may need to have her restore her status and then apply for the work permit. But if that is the case, it may be tough but she might as well just wait to get PR status especially if it would take too long to do the other stuff before landing.
 
My husband was out of status and was told to apply for OWP when he received AIP. He did so (mailed in) but landed before they started processing the OWP. Status did not seem to be an issue.

Technically though, AIP is not a status. If you are out of status, you have to get back into that first. As said even when they went to apply online, it wouldn't let them progress further because the status was already gone. I used to know how to explain this better before but I had learned of this all from matthewc. He is quite informative of the inland process.
 
Babyhangon, I would call CIC and ask them what you guys should do. I find them very knowledgable lately.

LY, how is everything going? Thanks for the chart btw. It looks great. I was just wondering what your thoughts are on some July applicants in the 2011 thread getting AIP. I mean, it is a very good thing but I was just wondering your thoughts on that and why only a few people in July have got AIP?
 
Sometimes they don't even stamp your passport when you enter. So how are they to truly know your out of status?

hi guys i just spoke on phone to a cic agent and she told me that they have approved me for first stage and sent me a letter on the 24th of november.Further more i asked her if i need to redo my medical or send my security clearance again? she said that they have not requested it yet so they will contact me if they require it again. As far as i can tell this seems to be a good news because if they are not requesting me to redo the medical and security clearance then they might give me the 2nd stage approval soon.What do you guys think, in case of both stages being approved together do you get the aip and the 2nd stage letters togther or is there a few days gap.

my 2nd question is ,,if i dont get the 2nd stage approval right away can i apply for my owp when i receive my aip letter from cic my current status is a student and i am graduating in a week so i could also get the three years post graduate work permit.....please advice me how to apply for the owp.

Yes,but they scan passport into their system,so they know if you are out of status or not and dont think they are not aware that you are out of status or not bcos they did not stamp your passport.good luck
 
@Babyhangon: you need to restore status before continuing. Otherwise it could lead to bigger problems. Also, you CAN NOT get your OWP online. If you do it there, you'll most likely be denied.
You HAVE TO file a paper applications at the PR department. I explained the whole procedure one or two pages back to someone else. I think it's the same form (IMM 1249) to restore status.

I don't know about the post-graduate WP, but the OWP at AiP is very easy to get. Just need to send it through mail.
 
CIC have finally updated. Working on apps on the 13th of Dec.
