Inland Application without legal status

Hi,
well, I was out of status during the hole process and I havent encounter any problem or delay. (got DM in exactly 1 year now waiting to "land") CIC states that people without of status cannot being refused PR in sponsorship for this reason, but carefull cuz there are a few diferent things in your situation and mine.

1. I came as a student, meet my hubby first day of school, after 5 months dating we move in together, got married a year after. We were 2 years married when I applied for PR base on sponsorship.

2. I lost my status when we were already married for 1 year and a half. In your case, if i understand correctly, he has been out of status for three years and dated this person for 2 years, so 1 year after losing status... that can be a redflag.

3. He had a SIN number and was working.. and still working illegally! That is a crime! he must know that! In my case, i came as only a student, and never worked... even know.. with dm and only waiting for the landing formality, i still not working...! i dont want it to ruin everything as that is in fact a HUGE redflag.

4. There's no way to "restore status". But if they do apply and reach AIP, he will be able to apply for an open work permit. AIP seems to me the hardest part, the evaluate the sponsor and the relationship.

5. They could apply outland as it seem safer for them since he is in a huge problem if they caught him working. But in my case, before applying, i ask call center agents and they suggested me to stay and fight inland.

6. when you apply inland you cannot leave canada. well, you can. but they suggest not to do it. and in his case even worst cuz he will not be allowed to re enter.

The CIC has his application and the CIC knows that he is working, if it was a MAJOR PROBLEM they would have contacted him already and done something...

Don't listen to a lot of people on this forum they don't really think before they speak as Clearly if it was a really bad issue they would have contacted him stating to stop working, in this case they still have not done that.

No CIC doesn't know that he is working as he is not doing tax returns so CRA doesn't know, and he has not told CIC. He is working on an expired SIN so it's perhaps his company that doesn't realize it's expired.

If he continues to work under expired SIN and CBSA finds out, they will force him to leave and give him at least a 1 year exclusion order from Canada. This would also make any family class PR application a very long and delayed process.

I agree. Dont know what the best solution for him will be. You can apply for Inland Sponsorship even if you are out of status but I dont know how the person explainswhat they've been doing for the past three years in Canada. Maybe just say the gf has been supporting her bf.

Well, I did apply being out of status (for only 8 months before the process) . I explain what I was really doing: NOTHING. I put "HOUSEWIFE" in occupation, and I added a few documents like wester union receipts (my family sends me money -actions of an entreprise) as a way to show how I contribute with my hubby.

Althought It did work for me to be out of status during the process (just got DM a month ago ), I have to say that is really a particular case. and I certainly DONT recommend it... the stress that gets into you cuz you know they can come right out you whenever they want, the fact that litterally you DONT exist..
The fact that it work out well for me, doesnt mean it will work out for everyone. I was lucky. But i know several inlanders getting deportation letters, fighting hard to stay, desperately asking how to stay...

So hey, no. If there's a way to stay always in status, then do it. Dont make my mistake.
I always tell my story not in order to be an example but only to be a true story. Doesnt mean I support the out of status thing...
Plus, working without of status IS A CRIME. it appears in all pages related to immigration.
I dont know why people keep saying "he will be fine"... you have to at least show us a link where it says "its fine to work without a permit" for us to be able to understand your point. cuz trust me, we can show you several links that says "working without permit is a crime"
