Inland application ...please help

Hi there...I have a question regarding an inland application. I am Canadian resident and my husband and I applied for spousal sponsorship in September of 2011 …still not heard from anybody I tried calling but it keeps saying all agents are busy…checked the status online it says in process…. My husband family member died recently so he went back to his country for a funeral..so my question is if he is going to be allowed back in the country….he comes from the country that doesn’t need a visa to come to Canada….we haven’t called cic office to let them know that he was leaving …please help

I'm very sorry for your family's loss. Unfortunately, I think it's luck of the draw whether an applicant can re-enter the country while an inland application is being processed. I've read instances of people being refused at the border (from a visa exempt country like the U.S., even when traveling with their Canadian citizen spouse). I had to leave Canada briefly during my application, and returned with no problems. I had flown to an airport near the border and had my husband pick me up, and we returned to Canada together.

I think success depends on the mood and understanding of the border agents. Hopefully your husband will have no problems returning.

thanks for your help... im so confused i been searching the internet all day trying to find out... can he come back as tourist? like i said he doesn't need visitor visa from the country he is from...

Sorry to hear about that! A close friend of mine is doing the inland process, her husband left for a couple of weeks to the UK and had no problems getting back in, I think it all depends on the immigration officer. We once took a trip down to the states as well and no questions were asked on the way back he was allowed in.

Yes, he'd re-enter as a tourist. Also, as long as you encounter no problems, he could use this opportunity to extend his visitor record (that way you save the fee of doing it by mail). When my husband and I re-entered Canada, we passed through the border with no problems (the agent didn't really say much of anything before letting us through), and we asked if we could see an immigration officer. The immigration officer asked if we had a copy of our application, which we didn't have (we had the receipt letter from CIC and a couple other things, but not our *entire* application). They spent a couple minutes pulling up my file before giving me another year-long visitor record.
