I have 2 important questions.

My husband and I have been together for more than 5 years and married for almost 2. We have a child together who will be 5 next month and he also started school this year.
I got really sick while pregnant and almost died and this is the reason he couldn't go back to his home country and ended overstaying here.
Together we have hundreds of pictures of all the places we have been and also of our wedding, honeymoon, Christmas, birthdays, pics with my family and friends, and also with his grandma and aunt when they came over for the wedding. We also have cards of all the birthdays, Christmas, father, mother's day, etc we have received from friends and family, and sent to each other along with a wedding invitation card with our names on it we received when my cousin got married back in 2012. We also also sent in support letters from my only brother, my best friend, my mom and one of my cousins. Here is the thing.. Almost 4 months ago we received a call from CBSA and they told us that they wanted to meet with my husband at their local office. We went to the meeting and after all was said and done they told us that they were not going to take any action against my husband and that they were gonna let us send our application for permanent residence. 3 weeks later we sent our application and about 5 weeks ago we received the AOR from IRCC or CIC . 4 weeks ago CBSA called us again and told my husband they wanted to meet with him. He went to the meeting and they gave him an exclusion order that excludes him from the country for one year, but since we have an application in my husband asked for a deferral of removal. They accepted it and told us that IRCC or CIC will review our application and if we are approved in principal then the exclusion order will be put on hold and we will wait until IRCC or CIC makes a final decision. They said that if we are approved then my husband becomes a permanent residence and stays in the country but if they refuse it he will have to leave and we can submit another application from his home country. Yesterday I received an email from CIC saying that I have met the requirements for eligibility as a sponsor and my husband will be processed separately and that they will contact him shortly. What exactly does that mean? and the second question is that today my husband spoke with the CBSA officer that gave him the exclusion order and she told him that like he still has basically 37 days left out of the 60 days they gave us for the administrative deferral of removal. We thought that those 60 days were only for the first stage of the application and that once we were approved in principal then the process was gonna continue its normal course. Am I wrong or is the CBSA officer wrong on this one?
Thanks in advance..

Why did they issue the exclusion if they said they weren't taking action?

AIP letter will say something like this:

This letter acknowledges receipt of your application for permanent resident status in Canada.
It has been determined that you meet the eligibility requirements to apply for permanent resident
status as a member of the spouse or common-law partner in Canada class. However, a final
decision will not be made until all remaining requirements for becoming a permanent resident
have been met. These requirements include medical, security and background checks for you
and, if applicable, all of your family members, both in Canada and abroad, even if they are not
applying to join you in Canada at this time. You cannot become a permanent resident until you
and all your family members have met these requirements. yada yada...

Also, have you checked ECAS?

It says this. You have met the requirements for eligibility as a sponsor. The application for permanent residence (APR) for your relative will be processed separately and she/he will be contacted shortly. Then it goes on to talk about my responsibility as a sponsor. And, yes they told us that at that moment they weren't going to take any action but once we sent the application they would. They just let us send in the application before giving us the exclusion order. They basically did us a big favor.

That is SA (Sponsor Approval), which simply means that you have been approved as the sponsor. This says nothing about the eligibility of the PR applicant.
Having said that, the [logical] next step would be for him to either get AIP, or a refusal of AIP. That could literally happen any day now, depending on CIC.

You now have to pray that CBSA's request (if they have made one) for CIC to expedite his application to reach AIP stage is answered ASAP.

CBSA can request this, but don't always choose to do so.

I have seen many of your answers to many of the members here and 99% of them are always negative or have a negative message on it. Things like PRAY, OR LUCKY, THEY DON'T HAVE TO, ETC. If you can't answer a question without putting negativity then don't answer it at all. Thank you and please refrain from replying..

Wow...clearly not the grateful reply that I was `praying' for.

Sorry to be the voice of REALITY for you, but you really are at the `mercy' of the system right now.

Do I hope, pray, wish, imagine, envision a positive outcome for you? Absolutely.

Ponga was just telling you a straightforward answer. CBSA doesn't have to give you any time at all for your application technically, and you haven't received AIP yet. Sometimes the facts may sound or be negative; that's life. Your answer was very unreasonable and unfair to Ponga.

All the negative things he said I already know about them and don't need anyone to remind them to me. It would be like
you are in trial and the someone tells you, well if you are found guilty you will spend 25 years in jail. Obviously you already know that and the last thing you need at that moment is someone reminding you this fact. And the reason I responded like this is because he always says negative things to people here. Don't you think that most people here are already full of stress and the last thing they need is negativity?

Unbelievable.

Ponga negative? Ha, hardly.

Don't blame someone simply trying to give you information for your current situation. She was using "pray" colloquially. It's a figure of speech, not a literal recommendation to pray.

Thanks.

I actually was suggesting prayer, as a means of empowerment, to give the OP a feeling of control/positivity...over a clearly uncontrollable situation.

Nothing wrong with that either!

Lol, that's funny. I don't see any negativity in Ponga's response, just the reality of the situation that you and your partner put yourselves in. And frankly, Ponga was a lot nicer about it than many others would be, including myself.
