Hello,
My wife sponsored me and now I’m a permanent resident since July 2017 PR for 5 years , the last 3 months we had a problems so some one recommended he to call the police because doesn’t want me to live with them in house anyway she called the police and accused falsely for
1) domestic assault
2) utter threat
The police arrested me and I was released in the same day because I don’t have any criminal record, never had a problems with the justice system,the judge ordered me don’t have any contact with your wife and I’m respecting his probation order.
The crown tells to my lawyer they will drop charges once I have completed the counselling ( men in change program) so no conviction in this case
Now my wife wants a divorce and we have small baby 9 months old was born in Canada , I can’t see my her because the probation order is still in place and she doesn’t want to remove it.
So my questions are:
After divorce the sponsorship breakdown or not?
After divorce I’m allowed to stay and live in Canada or not?
After divorce I will get trouble to renew my permanent resident or not?
Please someone can help me with any answer, I’m trying to do all the necessary to be with my daughter but my wife wants only divorce and she doesn’t want me even speak with her family to find any agreement.
So please I need a help because I’m new in Canada and i don’t know how does it works the immigration system

Hi there

Since you are already a Permanent Resident, nothing changes if you get divorced. There are no conditions any more. You can stay in Canada doing the same things as now, nothing changes in your status, and you will be able to renew your PR card.

You said there are no conditions any more. What are this conditions?
Sorry to ask you again but you know I have a baby and I want to be with her in Canada otherwise I go back to Italy.

There use to be a condition for sponsored spouses (condition 51) that required the sponsored spouse to live with the sponsor for 2 years before they acquired full PR status. That condition no longer exists. There is no such thing as renewing your PR. You only renew your PR card. Once you are granted PR status, you are always a PR unless you renounce it or the government revokes it. You only need a PR card to board commercial transportation to return to Canada. You are entitled to remain in Canada, even after divorce.

I understand, it is quite difficult with a baby...

The conditions, as explained by previous person, made you stay with the sponsor for 2 years after you get PR, but they changed the rules last year and those conditions do not apply any more. So, since you are legally in Canada as a PR, you can get divorced and be on your own, you don't needasponsor to stay in the country any more.

Yes, of course.

Make sure there is no police record about this, which I don't think there will be, but just double check, otherwise yiu can get a pardon.

Yes, I mean a record. A pardon might take about 5 months I think. Check with Police Department once everything is solved.
