Hi everyone, I was in Canada for 18 months at the moment of my arrival I was Issued a visitor record that stated I had to leave by the date of my returning flight wich was 12 days after my arrival.
I didnt knew that I had the possibility to apply for refugee at the moment I was there in the airport so after my encounter with CBSA officers I just left.
After that I was afraid to be removed from the country specially because I didnt wanna comeback to my home country (VENEZUELA) so didnt leave by the date of the visitor record.
I came back to my country 4 months ago honestly thinking the political violence I was feeling against me decreased by my almost two years outside. That wasnt the case.
I Study law in a public university and the same pro gover groups that were causing trouble back then are still doing it to the date and has worsened.
Even though I have spoken with legal representatives that might help me with my case
I am not sure if i will be sent back to Venezuela claiming a refugee status case at the port of entry given the fact that I did overstay, and didnt comply with what the visitor record issued stated.
Im not sure if a removal or deportation order was issued or not, I didnt had any interaction with CBSA officers when I left Canada.
It was never my intention to mislead the officers but that happened.
Im thinking that this will have a negative outcome my refugee claim at the moment I arrive to canada.
My real question is if i have any chances to be accepted by the officer and be reffered to the IRB for processal.
It could be the case they understand that I might just be using the refugee claim option just to comeback to the country and could be a flight risk given the case my claim is not approved
How possible is to be deported? Given the fact I was issued a visitor record that after the moment of my overstay the officer told could become eventually in a removal order and ultimately into a deportation one. But I left Canada voluntarily and didnt had any interaction with any officer so that for me is an if.
Thank you very much. My Visa expires on August and things worsening by the minute here got me to the point I Need to comeback ASAP and take the chances. What would be my best option? thank you for your help.
