Is it still possible for me to receive an ITN while on implied status? I will be for another 5 months since we applied inland with OWP request. I am hoping that I can receive one so that we can file taxes with more ease next go round.

If it is possible, how long does it take to receive one? Also, since I didn't have one when my hubby filed for his tax return at the beginning of this year they said that they couldn't find that he was eligible for GST/HST checks. He definitely was though but since I couldn't supply a SIN number they made us pay back almost $200 to them. If I get an ITN, are we able to still receive those checks he deserves or is it too late for that?

And while we are talking about tax credits, is he able to file for disability credits because he is also entitled to those as well but he is afraid to file it for fear on him being refused as a sponsor.

Not sure what you mean by ITN, but I know that even with implied status, you can file a return (even if nil income) and revenue canada will process it and supply you with a temporary SIN. I think you may need to fill out the determination of residency form and submit it to the international tax services office, along with your 2009 return (or 2010 if you decide to file for the 2010 year.)

Did your husband file a joint return for the two of you? This might have been the problem as they didn't have you on file. Definitely contact CRA on their toll free help line, I've found that they are very helpful in answering questions. If they find that they have made a mistake they will rectify it.

As for disability tax credits that should be fine, the only barrier to sponsorship is receiving provincial welfare. Keep in mind that disability benefits such as ODSP do not count as welfare.

An ITN takes about 4 weeks to get. Fill out form T1261. An ITN is for people (usually non-residents) who are not eligible for an SIN but need to file a tax return.

Your tax preparer can file an ITN request for you also - that's what ours did. Not complicated at all.

Is there any sort of tax preparer I should be looking for to help me with both US and Canada taxes when that time comes?
Would H&R Block not do?

Thank you for all that answers. I am still curious about the disability tax credit. If someone could help answer that question, I would be grateful.

Disability Tax credit is given to those that can prove they have certain disabilities.

You can download the guide and form from Revenue Canada. It has to be signed by someone from the medical profession.

Check the guide to make sure your husband qualifies.

If your husband filed a joint tax return for you both, I believe you do not need a SIN number as you are not working.

He should be allowed a certain tax allowance for you, as a non working dependent. Again, check out the Revenue site, it is actually very good for a government agency site and will answer most of your questions. Also, their call center works well too (go figure) and the people that answer the telephone seem to know what they are talking about... ;D

I am aware of the steps he would have to take to apply for disability. He does qualify because he has a disease that is life threatening. We filed a joint tax return last year without me having a SIN. They said it wouldn't be a problem. He did receive a GST check but a couple of weeks after that, we received a letter from CRA telling us to pay it back to see if we qualify. We called the CRA and explained our situation and they said just to write a letter describing the situation and tell the world income. We did that but they still said that they could not determine he was eligible. We just gave up on it after that as we figured we would just wait until next tax year. However, we did file as common-law then so maybe if we submit proof of marriage and etc. they may actually do something about it now.

However, that still doesn't answer my original question about the disability credit. If he applies for disability credit, will that count against him as a sponsor? I know disability in itself can't but does disability credit also count in that category?

Sorry I misread your initial post. No being disabled does not count against a sponsor. Only those on welfare or bankrupt are ineligible to sponsor.

Disability tax credit is a working credit, not welfare.

So if I am correct, it would be alright for him to apply? That would be good news for him as he deserves it. I have a diasbility tax credity from 2011 im awaiting mps help to try and resolve they denied sponsorship because i applied in jan 2014 and odsp was given feb 2014 so that one month difference they are saying i wasn't disabled but My Disability tax credit says otherwise!!

So im waiting to see if the MP can help me. He said he will make an inquiry and thats not nice, and he understood my situation CIC fails to understyand you can be disabled on ONtArio works too Doctor decides not the actual Program!!
