Hi All,

I got my Indian PCC on 19th of Jan 2019 and I am living in Canada since December 2017. Meanwhile I visted India after that for 3 weeks in the month of July. 2109. Now when I get my ITA, can I use this PCC as did not live in India for 6 or more than 6 months after the date I got my PCC.

Yes, you can. However, chances are that office may ask for new PCC as current PCC is almost 7 months old. Refer official link below"

https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/express-entry/apply-permanent-residence/police-certificates.html

Date the certificate was issued
For the country where you currently live
The police certificate for the country where you currently live:

  • must be issued no more than 6 months before the date you submit your application
  • must not be expired
For any other country
For any other country, the police certificate must be issued after the last time you stayed there for 6 months or more in a row.

Some countries put expiry dates on their police certificates. If you have a police certificate that expired, include it. We’ll accept it if:

  • it was issued after the last time you stayed there for 6 months or more in a row
  • it is not for the country where you currently live
An officer may ask for a new one later on.

Thanks for the quick reply. But it seems this is for the PCCs that have expiry date on them. Indian PCCs do not have expiry date.

Statement highlighted in blue in context of your query in 1st post applies to all PCCs (with or without expiry date)

Your PCC doesn't cover your most recent stay in India. You would need a new PCC. In any case if you had PCC in Jan issuing new one woudn't take time. So, just get a new one.

No he doesn't need one as per the guidelines. The guidelines are as follows:

There is no requirement if his recent visit to India covers only three weeks as opposed to 6 months in a row. If an officer asks for one later on after submission, for his own satisfaction, then that's an entirely different situation.
He needs to only get it after such a request has been made by the officer.
