[IND] Spouse Immigration Options

I was going through this sub forum and other similar forums but couldn't find the current estimated timelines (or maybe I didn't search enough), so wanted to create this new thread to all those who are in similar situation. I am currently on WP in Canada and soon will be getting married in India. I was going through the current options on what could be the best way to bring my spouse with me back to Canada and below is what I found:

  • Visitor Visa + Authorization Letter: Due to COVID, there seems to be a way to request for authorization letter along with applying for visitor visa as part of Coronavirus disease (COVID-19) and visitors to Canada: Uniting with family members. To me this wasn't the bad option but I would like to know is there any estimate on how long this would take? Current major blocker for this I see is biometrics appointments for visitors aren't allowed in India which means my partner need to travel to other country to get this done.

  • OWP: I am guessing I can apply for this option as well, but once again it is the timelines I am worried about and I remember reading a rule saying even though spouse has OWP, he/she can't travel unless there is a job offer letter? Is this true or can someone confirm on this? Also, does one require authorization letter in this case as well and if they have one can they travel without job offer letter Work Permit - Current Rules?

  • PR: I am still in the initial stages for this, but this looks like the last option that I have as I still need to give IELTS test. Is there any timeline on how long this would take from the time we start applying until we get the PR and are there any current restrictions around this as well?
Edit: Currently I am on WP, living in Canada and will soon be applying for PR.

Most spouses of PRs and citizens struggle to get TRV. You should hear within a few months maximum if you highlight that spouses meet travel restrictions and request priority processing.

If you are a citizen or PR your spouse does not qualify for an OWP. They would only qualify for an OWP if you applied for inland sponsorship with an OWP. Your spouse would need the TRV to get to Canada first.

Are you a PR? You said spouse immigration but said ”we”. You should really be posting in the family sponsorship section.

No, I am currently on WP and I said "we" because I need to apply PR for both of us. I will edit the original thread as well and cross-post it to family sponsorship section.

1. Yes your spouse needs to travel for biometrics to other county. And timeline is not 100% accurate. Your spouse may get prioritization as an immediate family member.
2. Until travel restriction is ON your spouse need a job offer with OWP to travel to canada during this time. However that may takes long due to backlogs.
3. You should count your CRS score before getting married as after marriage Your CRS points may get down. And If you wait until you get PR then i would say it would take 1 to 2 years as you have not started your PR yet.

In my opinion if your CRS score is good after marriage or Your can get PNP then go with OWP that will allow your spouse to complete biometric in india. Then apply for TRV so same biometrics will be linked for both application. Meanwhile if OWP approves then she can travel with out job offer after travel restriction lifted.

This is just my opinion. You must consider step according to your priority.

Thank you for this. I was planning something similar as well. Apply for WP - there by completing biometrics in India, then apply for TRV and hope that it is approved and we get the passport back soon enough and travel.
