Incorrect Review and Refusal of EE App

Hi All,

My express entry application has been refused and the reason was that I didn't provide police clearance certificate from the UK. Meanwhile I have NEVER EVER LIVED OR ENTERED THE UK IN MY LIFE and I didn't state that anywhere in my application that I have LIVED OR BEEN to the UK.

The only association I have with UK is undertaking a distance program from my home country. My resume and all documents I submitted indicates I was working in my home country while undertaken the program. I strongly believe with no shred of doubt that my application was incorrectly reviewed.

I'm confused what and I would like to know my options.

so sorry to hear about your refusal.

write a very polite letter of explanation , explaining that u had distance education course from UK but never went there etc and request to re consider your case ...send it via Case specific enquiry

I remember someone else last year had the same problem, again with UK. Search for it in this forum, it might be useful.

This is an obvious mistake on IRCC's behalf. Send a CSE, politely explain the situation and ask them to reopen your application. There shouldn't be any issues with that.

Raise a CSE uploading whichever documents stating you were enrolled in a distance course.
What is your AOR please ?

I've submitted the CSE. Apart from my EE profile with indicates that during that period I was working in my home country, the only evidence I have is a copy of my transcript which shows the address of the institution I took the program in my home country. I hope this and my explanation helps. I will give you the feedback.

You may also resubmit all pages of passport (including blank pages) to show that you never entered UK.

AOR = Acknowlodgment of Receipt = The date you have submitted your PR Application.
I think the transcript with your explanation would be sufficient to find out that you had never been in UK. You can uploader your passport of that period as well, to proof that you were in your home country.

Someone else on the forum had the very same refusal. Italian resident, never been to USA, studied a US distance program, rejected for not providing the FBI document. Not sure but I think it is under the topic named Reasons for Rejection.

Is it because they put the country "US" or "UK", for example, on the respective course's Education details?
If so, maybe that question should be answered according to where the applicant was while taking the distance course.

Makes sense, it could be the reason. But still, it should be a no-brainer when the agent sees conflicting whereabouts, no visits to US and/or UK on the travel history, and a remark of "distant education" on the diploma etc...

I think I remember that as well.

Its funny that IRCC seems to have such an issue when it comes to distance learning programs. You would think it would be obvious enough to see whether somebody actualky lived in a certain country to study or not.
