In-Land Step 1 Time

We need some help here.

According to the processing times, they are as of this writing working on in-land spousal sponsorship applications for September 28th, 2012. That is really, really far behind.

It also says that it will take them six months to process the initial assessment.

Does this mean that when it finally comes around to when my application was received, which was around the start of February, it would take six additional months before I receive implied status?

There are four whole months between September and February. Adding six on to that would mean I would have to wait at least ten months before receiving implied status.

I hope this isn't the case.

If it is, I may be in trouble. I've already extended once before sending in the application. Extending again, I don't really know how many months I am going to receive. In fact, assuming I am going to receive three months of additional time for my extension I am going to file now would mean even without the 'added processing time', I would need to wait out for four months, that's one month too many.

And the AOR which I will be receiving at the conclusion of Step 1 will give me the implied status keeping me from worrying about all of this but I don't know how I'm going to make it that far.

Any input would be appreciated.

Your six months start from the day you submitted your application which seems to be in February. Therefore you won't get get first stage approval until august. If u had status when you sent in your application then you have implied status and you don't have to extend it. And remember in the spousal class you don't need status to be sponsored. You are OK.Y just have to wait like everyone else.

Wow, so if you're right I don't have to extend at all then and just wait it out.

I'm still relatively 'on edge' though, can some others validate this information? I've attempted to research this on my own in the past but received several different answers due to what I believe were their different circumstances involved.

If this is wrong and I do need to extend in some way then I'll be in major trouble so I hope my concern is understood.

So to clarify, if I have submitted an in-land spousal sponsorship application while I already have status and they have already received it, I don't need to worry about anything and just wait?

There was also a form that needed to be corrected shortly after they received the application in February however I immediately corrected the mistake and submitted it to them in the middle of February.

I find it so strange that if this is true I can actually finally not really worry about anything and relax, not needing to be concerned about extensions anymore.

Was it difficult to understand what I said? You have status already and you don't need anything. If when your visa expire and you want to extend, it is up to you.CIC won't mind your money. Don't extend your visa until it will soon be expired. As a spouseu don't need status to apply

It was written very straight forward, however I am just in a moment of stress and caution so I'm a bit paranoid. I don't relax very well when it comes down to things like this.

I have trouble grasping the context of this.

Ha, I get that the CIC wouldn't mind my money. At this rate even the water pipes in all of their buildings should be composed of gold and their doormats the finest of silvers. I'd be disappointed if they weren't.

My visa expires soon but they have already received the application, which would if I am understanding this all correctly give me implied status which would mean that I would have no need to extend my stay to remedy the visa expiring. Basically, I'm asking if I can let my visa expire while in Canada due to them receiving my in-land spousal sponsorship application. I will be in Canada during this entire time so I want to make sure I won't be asked to leave. I understand I could infact technically attempt to file an extension but I assume what you're saying is that it would be a waste of money and that I could still happily stay in Canada due to them receiving the in-land spousal sponsorship application.

Forgive my dense nature with these sort of affairs but it's an unnerving matter for me. Am I correct in my understanding of all of this?

Did u submit an application for an open work permit? This would save you time so that when you get approved, the work permit comes to u within a few days,but if u wait for first stage approval then you'll have to join a long que to apply for it. A work permit application is very essential because even if you're out of status it puts you back in status same time. Plus if they finalize your step one and simultaneously they'll refund the work permit money. I'd encourage u to go ahead and apply for it. I was out of status 5 months before I sent my application in and later I sent my work permit application. I'm supposed to get first stage next month, God willing

No, I didn't submit the OWP.

What I'm more concerned about is you said you were out of status for five months. Aren't they supposed to ask you to leave when you're out of status? If being out of status does not cause you to be asked to leave then what is the importance of being in status again?

We filed our in-land spousal sponsorship application while I was in status so I should be alright and receiving implied status when my visa expires. Is that the same as no status? Man, this is confusing stuff here.

I don't need to extend my visa due to filing the application while I had status, if I understand that right.

When you're a spouse the immigration regulations allow you to stay while you're application is in process. I have said this same thing to you in all my replies. Why would they ask me to leave and I'm not a criminal. I'd recommend you applying for the work permit. What is your nationality? I am Jamaican

Zebra I am in the same boat as you, and to be honest I'm glad you insisted on clarifying as I wasn't really following either! Are you working? That's what I'm worried about.. I thought implied status was for a max of 3 months? No? And if you are to leave while you have 'implied status' they don't have to let you back in?
As I'm a temporary resident I believe my SIN expires and can't be renewed without a visa....
So confusing...

I don't believe implied status has a time limit, it's until they make a decision on whatever application was filed when it is received.

You lose implied status when you leave Canada.

Implied status expires when the final decision is made on your application. And if you leave you risk losing that status . Some people actually leave after AIP with their spouses for short visits especially across the border and are allowed back in with little worries or no worries
