In Land Spousal sponsorship help!

hi I am just new here and I have a lot of questions about this In Land spousal sponsorship and I know I am not the only one in this situation. I just arrived here in Canada and I'm under a work permit visa and my husband was a Canadian Permanent Resident already. I indicate on my application that I was married with my husbands name on it and that he was living here in Canada and I also include the name of my daughter of course.

Now my husbands trying to sponsor me In Land but He also wanted to include my daughter on the application form but she is still in the Philippines. Is it possible to do that? How? and how long will it take us to get approved by Canadian Immigration?

It will mean so much to me if you answer my question just to clear my mind. He's not yet sending the application I just want to be sure first if it is possible before we send it to Canadian Immigration. Thank you!

How did your husband got his PR? is your husband already a PR when you get married? Because if he did not put you and his daughter before he bacme PR hes not qualified to sponsor you.

You include you daughter as your dependent on the application, either accompanying or non accompanying. But she must have a medical. Inland applications, about 19 months.

were not yet married when he got hes PR. we just got married last year is it possible for him to sponsor me in land and my daughter out land in the same application?

yes i included my daughter on my application when i applied for working permit here in canada that was year 2009. at first i ddnt put my husbands name on the application so the dependant on that time was my daughter only. then when my husband went back home last year we decided to get married after that i immediately informed canadian embassy about the change of my marital status, i also re new my passport cause of the change of my surname. now im confused whether it will be too long for us for the inland sponsorship though canadian immigration knew that i am already married to a PResident in canada.

Hi yffAm,

Just a few questions for me to understand your situation:

1. When your husband got his PR, what is your relationship?

2. Did you have a child before or after he got his PR?

If you are common-law (marriage-like relationship at least 1 year) before he got his PR, and he didn't declare you as such, he cannot sponsor you. Same thing with your child.

we already had a daughter when he got his PR. Our daughter was already 4 years old when we got married. I asked him if he filed that he had a child in his PR application he said NO because he said that he asked them if he needs to file that he had a daughter in the philippines they said NO. thats what he told me.

we are common law partner before. we're just married last year.

yffAm - from everything I've read I don't think he will qualify to sponsor either of you. He withheld that information on his application and CIC won't like that at all.

I agree with Angus. You have a big problem on your hands. Neither your nor your daughter can ever be sponsored by your husband.

In addition, your husband also committed misrepresentation by failing to delcare you and his daughter before landing. If CIC finds out, he could lose his PR status.

can you guys give me an advice on how and what to do for us to bring our daughter here because im really really missing her so badly and i dont know when or if i can go home for me just to see and hug her again..

I agree with the others.

I don't think your husband can sponsor you. Your best bet now is to get an immigration lawyer who can maybe help you out. But there is a good chance your husband will lose his PR if he applies. In that case, the best thing I can recommend to you is for you and your husband to return to the Phillipines (if your husband has Phillipino citizenship that is)

or maybe ill just wait until my contract is ended then apply PR for my self so that i can get my daughter eventually.
