Hi,


I am currently a Permanent residence holder and I live New Brunswick

I got married to the girl who received student visa to Canada.

Our Marriage happened in India and after the marriage, my wife joined in college in Toronto with the student visa.

Now we both live in different places because i am continuing my job in New Brunswick and she is continuing her studies in Ontario.

I want to apply for the Spouse Permanent Residence with a work permit to her.

I also have a Brother in Canada with Permanent Residence and I noticed in CIC website when any relative is PR in Canada I shouldn't be applying the PR under Inland-Family Class.

Can you please help me what is the better way to apply PR to my Wife?

If Apply Out-land PR will my wife gets the Work permit after her 1-year study?

Yes - if your wife qualifies for a PGWP after she completes her studies - then she can absolutely go ahead and apply. Having a PR application in progress won't get in the way of the PGWP being approved.

You do not qualify to sponsor her INSIDE CANADA way, since you don't currently live together. A requirement of an inland app is that both sponsor and applicant are living together in Canada in the same home.

She should apply using the OUTLAND method. Of course she will not be eligible for OWP this way.

Your brother's status is completely irrelevant to your wife's PR app.

Usually after a study permit you can apply for work permit for the same length of time as the study permit, so she can do that while waiting for sponsorship processing.
