Hi.

Here is the situation I am in.

I am working as an administrative assistant since 10 months. I am currently under PGWP which expires in 2 weeks. 2 months ago i applied for my PR under federal skilled worker and also LMO (Just incase i needed to apply for a work permit at some point)
My employer kept calling for the LMO and yesterday we go the news that they are sending the application back with a refund because I am not eligible to apply. I don't fall under whatever category. My employer suggested since I haven't heard back regarding my PR and they don't want to terminate me that i should just apply for a work permit indicating in the application that I have applied for an LMO but haven't heard back yet. Just to buy some time.
I'm hoping my PR application is strong enough and won't get rejected. But the time it's taking is the problem.

Do we need a positive LMO to apply for a PR under federal skilled worker class?

It depends what occupation you applied under. What NOC did you use in your application?
 
I'm assuming you applied May 1, 2014 or later. This NOC isn't on the occupations list. This means you need an approved LMO/LMIA to qualify to apply for PR through the FSW program. I assume you included an approved LMO with your application? If not, then I think you should be expecting your application to be refused since you don't meet the criteria to apply.
 
I haven't attached the LMO. Does it not matter that I already got the job?

No - it doesn't matter that you already have the job or that you are on a PGWP. An approved LMO is mandatory.

Great.

Now if that gets rejected I am just going to apply for visitor's and stay and sort things out.

The first time i sent my PR application it got returned because i forgot to add my birth certificate and they wanted a letter from my previous employer indicating i worked full time. There were quite a few things on the list they sent and highlighted the ones which i need to send back to them. LMO wasn't highlighted.

Anyhow.

Whatever. I'll just wait
