I am going for the inland immigration process. I am in Canada now. I had a 6 month tourist visa, but while clearing immigration the officer changed that and made it a month. Now i have only a month to stay in Canada, pls let me know will I still be able to proceed with applying through the inland process of immigration under spousal class. I am really in a fix as I have very little time.

1. I was thinking of consulting with a lawyer, was thinking of contacting David |Cohen's firm

2. Should I return back to my country after a month or should I stay on illegal status if my visitor visa does not get extended.

Staying illegally sounds like a surefire way to get your application tossed in the trash.

But the law says that a spouse need not maintain legal status while her application is getting processed. Isn't that effective

While that is true, I wouldn't be surprised if that caused a delay in your application. But then again, at least you'd be together....

I would suggest keeping a legal status if you can, my husband didn't and he was issued an exclusion order in april, the day before he was to be issued his PR. So now he can't come back to the country for 1 year, even though all his paperwork for his permanent residence is complete. They will not give it to him until the 1 year has passed.

I'm trying to appeal it right now, but 3 months later i'm still having no luck. And i spoke to the man that issued the exclusion order today, and he said that he highly doubts my husband will be able to come back before that time.

So if you can, keep a legal status!

Thats my advice.

And i've heard there is supposedly some "law" that spouses shouldn't be seperated, and are allowed to wait, but this doesn't seem to be applied. But i think that might be a policy and not a law... and really i'm trying to understand these things but i still don't. Like for example my husband under a policy stated that he should have been given a departure order, then he could have returned at any time. But the law says to give an exclusion order - cannot return for 1 year. This is very contradictory, and doesn't make sense, as other things... the more i look into it, but i possibly need to look more.

I just hope it will be resolved soon because this is ridiculous, and my husband and i have been married for over 2 years, and our marriage has already been bonafided, almost a year ago. But this possibly doesn't matter to the government, but only time will tell when they get back to me... supposed to be next week.

OH well, good luck to me, and maybe someone will learn from my experience.

And hopefully that bit made sense :)
