Hi there.
I applied for In-Canada sponsorship for my wife. She is in Canada with working holiday visa which is likely to be expired before she gets PR status.
I have several questions on extending her temporary resident status.

1. Does she have to be employed at the time of applying for the extension?
2. Does she need to provide job offer letter and Labour Market Opinion to be qualified, even though she works part-time? She got neither of them from her employer.
3. If she's not eligible for the extension of her work permit, is it possible to change her status as visitor to extend her temporary resident status?

Thanks in advance.

application received : March 11, 2010.
application processed : May 27, 2010.

Hey,

She can extend her stay as a visitor. You have to send out a change of status application at least 1 month before her work/holiday expires. In the application state that you have an application for permanent residence in process and she would like to remain in Canada with you. Include the receipt, a letter from you claiming your support and whatever they ask for. You can ask for a year.

Considering she holds a part time position she most likely wouldn't be able to continue working. The employer has to advertise the position on job bank sites and get a positive LMO in order to get a work permit.

Thank you for the reply. She just began applying for visitor status, but it looks like it doesn't require a letter from me claiming my support to her. Is it still better to include the letter in the application?
