In Canada on a visitor visa - Can I apply outbound?

American here, living in Canada with my common law spouse on a visitor visa. Been here since last May and it's valid until this November.

I called to set up an appointment for my medical exam and the woman on the line told me that seeing as I'm here on a visitor visa and applying outbound, that the CIC office can look it up, see I'm here, and send it back to us. I've been told that I can still apply for outbound as long as I'm not on a work or study visa here. Can someone please clear this up for me?

You can do this, no problem at all.

Seriously, though, you can absolutely apply Outland even while visiting in Canada. MANY visa-exempt spouses do so.

In her defense she said she was just instructed to tell people that. But it did give me a little bit of a heart attack. Who needs morning coffee when you have immigration stuff to scare you awake?

People on this forum often report that the receptionist and even the doctor (DMP) had given them incorrect info about the immigration process. There are various immigration streams, and the requirements are slightly different for each, and clearly the DMPs and their office staff are confused sometimes.
So basically the receptionist is wrong. You can definitely apply outland while you are in Canada on a visitor visa - lots of forum members have done so successfully.

Bumping this because I was told this again at the medical exam today and she said my file could be sent back because of this and she's heard of it happening to other people.

Has anyone else even been told this? And what would happen if my file was sent back? Will I have to go through the whole process again including the medical and background check but file for inbound? I just want to be absolutely sure that I've got everything right before I send this off.

Hello? Stop listening to the lady at the DMP's office, OK? She may know of one case, with totally different circumstances to yours, and continues to harp on it without knowing anything about anything.

I repeat....MANY MANY MANY visa-exempt spouses have done what you are now planning to do, ALL of them successful in obtaining their PR.

The only reason I'm still concerned is because she was saying that she received emails from people at the CIC. If she said it was from a friend of a friend who works for whoever I wouldnt give it a second thought.

If she IS receiving emails from CIC, it has nothing to do with spousal applications, or else she just completely misunderstands. Stop worrying about it.

You have the right to have your application processed by the Visa Office responsible for persons of your nationality regardless of where you live. So, you could be living in Timbuktu, as an American citizen you would still have the right to apply through Buffalo, you would not be compelled to apply through whatever office is responsible for Timbutktu.

So, once again, residing in Canada does NOT compel you to apply Inland. Furthermore, for most Americans, this method is a waste of time, because the Buffalo is much faster than Vegreville. In the time it takes Vegreville to open your application (10 months) you could be processed through CPC-M (40 days) and Buffalo (4-6 months) and be landed and be qualified for your health card (3 months).

Been trying to contact them for two days and always getting told it's busy.

I'd be worried that she might have the wrong forms, or has filled them out incorrectly. She is clearly mixing up the different types of immigrants and the medical exams needed.

Lots of people apply outland while actually living in Canada - because officially they are visiting, so they can apply through there home countries and do not have to apply inland. You're safe.
