if status is valid until August and dont qualify to apply as a spouse until October can I wait until then to make application under implied status or is that a no no

To have implied status, your application must reach CIC before your status expires in August. If you wait until October to apply and don't do anything about extending your status, you'll be applying out of status and will not have implied status.

So would probably be best to reapply for visitor and then put in sponsorship application

It s either you apply for visitor extension like you said or else apply for your permanet residence now, if you are eligible
