Implied Status and ITA

Hey Guys - Bit of a long one

So my friends visas are up on May 13th and they have set up their profiles for express entry but are waiting for their ITA. They are thinking of applying for the BOWP by mail a week before their permit ends. If they dont have their ITA by then they hope that with the 100 days BOWP by mail is taking they would have hopefully got an ITA and AOR by the time CIC open their BOWP application. If they dont get ITA at least they will get extra time in Canada. My question is this I understand you cant get BOWP without AOR but are they illegally in the country if they havent got an ITA and they applied for BOWP ie go on impled status. They are worried that when the CIC open there application for BOWP he will see that they dont even have an ITA so would he think they have worked here illegally past their work permit ?

The current work permit type is somewhat important. For example, some members of this forum will state that implied status does not apply for people on IEC visas.

Otherwise, I would say that it's a little bit of a gamble, but everything seems to come down to the discretion of the immigration officer. Plenty of people do apply for the BOWP without an AOR (myself included) and have had no problems, but they generally know that their AOR should be on it's way.

I would probably be waiting at least another month before I made my decision; hopefully the points requirement will seem far more obtainable by then.

Don't quote me on this, but your friends can submit the paper application for BOWP closer to the expiry date and see if they can ITA. If they get ITA and submit their PR application to obtain the automatically generated AOR then they can submit the BOWP along with that AOR letter.

Did you submit a BOWP before your work permit expired? Or did you submit a different kind of work permit application before your work permit expired? To be on implied status - you would have had to have submitted some kind of work permit application (or applied to convert your status to visitor) before your work permit expired. You're going to have to provide more information if you want us to help you.

Hi scylla.. We have the same situation of 1cook..wp expired feb 26..got ITA feb 27.. Implied status.. Applied for work permit extension feb 19 using a letter from ainp for 1 year bridging work permit.. Can i still calaim the 600 points? Should I push through with EE pr decline it? Thank you.. Really confuse on what to do

You can apply for your BOWP as soon as you have the AOR.

Can I work on implied status once I submit BOWP. If my work permit has expired on Jan 1, I apply for BOWP on Jan 15, Can I start working from Jan 15 or do I have to wait till I get my BOWP?

No...you are on implied status when you apply before the expiration of your work permit.

You cannot 'start' working on implied status, though you may be able to continue working.
