Hi, I have a 2 year old daughter and I am separated from my spouse. I want to apply for Canadian PR and will be including my daughter, and excluding my husband. My divorce is not finalised and it might take a long time. I am the natural legal guardian for my daughter since she is less than 5, and the father is in any case not interested in her custody. I have been told that when i get the ITA, I will have to produce an NOC signed by the spouse as one of the documents required for issuing the visa. He will not be cooperative and might refuse to sign the NOC. Please suggest if there is an alternate way for doing this.
