Hi,

If a Canadian citizen wants to sponsor a spouse from Pakistan, it takes 32 months before the whole process completes and the spouse is actually united with Partner in Canada. However, this time is significantly less from the UK, around 11 months I think. So, my question is, can a spouse who is a Pakistani national be present in the UK as a visitor and the application by the sponsor is made from the UK? Is this allowed? or a it has to be from the the country of permanent residence (in this case, Pakistan)?

I was actually just reading about this online... just over a debate with my friend

and I found this

"Applicants for Permanent Residence
You must select the visa office that serves your country of nationality or the country where you have been legally admitted for at least one year."

Have a read of the above link, it sounds like to me that if you have been staying legally in the UK for 1 year then you can apply through the UK Otherwise it has to be Pakistan

All family sponsorship cases from Pakistan is now processed in London. So London timeline of 11 months apply to you when you apply for your spouse.

Well, a multiple visa holder person can be legally present in the UK for 6 months as visitor (entry is limited to 6 months), then leave the UK and come back again the next day for another 6 months, which is legal. Would that be acceptable by the Canadian Immigration?

London actually processes all of Pakistan's Permanent Resident applications (as ariesking pointed out)

It shows that London's 11 month processing time will now apply to you anyway, so it doesn't matter about your status in the UK
 
1) Files are handled by London VO as part of work distribution, not all files goto London
2) The 11 month timeline doesn't apply to Pakistanis - they go through stricter scrutiny and 32 months is normal
3) Getting a visitor visa > enter UK ( 6 months stay on officers discretion and then entering for another 6 ) is not the smae as being allowed for 1 year ( which is mainly for students or ppl on work permit ) coz every time you enter as visitor it's 6 months, you leave its forfeited
4) There is a matter of sending passports outside home country issue as well ( if you somehow manage tyo get this accepted in UK )

They will tell you

No one is sure which timeline 11 or 32 months will apply to Pakistanis spousal application in London, but i am closely following the progress and couple of applicants who applied in august 2013 and their files were sent directly to London were approved in June/July 2014, so it seems like 11 month timeline will apply, however as we know 11 month is the completion of 80% of cases, some cases will fall under rest of 20% and will take more then 11 months.

Visitor's visa is not a resident visa, you need a resident visa and have to reside in UK for 1 year before you can apply.

But this is irrelevant in your case because all Pakistan spouse application are now dealt by CHC London.
