Hi there,
I was wondering if someone can advise me please.
My ex partner and his new family are applying for PR in Canada.
Our daughter and I live in England. We are not moving to Canada (even though I'm sure it's very lovely).
He wants me to get a medical done on our daughter for his application.
After reading some of your posts here, I am somewhat comforted to discover that there is a non-accompanying section but I don't know if this is how she appears on the application.
If I agree to the medical. I'd like to know that this is not somehow going to work in his favour in any custody battle that might ensue. I have no idea of Canadian law and don't want to leave myself open to losing my daughter just because I wanted to help him out.
Any help is most appreciated in this matter

I am not an expert in Canadian law but he cannot bring her to Canada without your consent (unless he has sole custody of her). Just make sure you do not sign the approval form to accompany her (a form that Cleary explain that you accept her to leave and live with him in Canada - this form need to be signed and notarised).

The requirement to do a medical for her is to make sure that she represent no threat to Canadian health or will be a burden on Canadian health system if he decides to sponsor her in the future. Even if she is not going with him, she must have the medical test, for them to approve his application (even though she is not travelling with him).

You don't need to worry. As long as she is listed as non-accompanying the medical exam is only to keep the door open in case she wanted to immigrate in the future. Non-accompanying means she has no intention to go to Canada at this time, and will not be issued any PR documents. However if she doesn't do the medical now, she would be banned forever to be sponsored at a later date by her father.

It's always good to keep this door open, since you don't know what the future will bring. If you were unable to care for her in the future for whatever reason, or maybe after high school she wishes to pursue university in Canada and avoid international tuition fees (before age 22), it will only be possible to get her PR status at that time if she does the medical now. Once she passes the age of 22, then the door is closed for her to ever be sponsored by her father.

Note the medical consists of a simple doctor check-up, some blood work, and a chest x-ray. It will cost several hundred pounds for the whole thing, which I'm sure the father would be happy to pay for.
