My husband is a Pakistani national, living in the UK, he was on a student visa but his visa expired in 2013, before it got expired, he already applied for a business visa which was refused last year. However, he had the right to appeal and he did. We are still waiting for a response for the appeal. When we got the refusal, the document that we received stated that if we appeal, his previous leave and right to stay will be extended until the appeal is resolved. We are all set to apply for Canada, we have an attested photocopy from the Home Office because they have my husbands passport at the moment. My question is when CIC does see the expired visa and the explanation from my husbands lawyer explaining we still havent received a response, would that be enough for them? I figured they will enquire his status in the UK themselves and find out that he is indeed legal until the appeal is resolved. My immigration consultant is giving me a hard time and is always asking if my husband is legal and thinks that I have no clue but she is the one who has no clue! Hell, we even registered our marriage in the UK despite having a nikkahnama, he is legal is the UK and so is our marriage. Can anyone provide any insight?

Just get your papers off . Cic will want his history as you well kn0w filling out the papers . Don 't leave anything out and just give an explanation like you have done here.

A good consultant should ask questions--lots of them. It looks like your application is somewhat complicated. If you don't like that consultant....find another !
