I know some people who got in legally through a lawyer without taking the assessment. And they are in a similar situation as I am. How is that possible?

What assessment? Anyone immigrating through an economic program needs to meet the requirements, which means skilled work experience, official language test results, assessment of education credentials etc. You need to get a high enough score to be invited to apply.

I'm not sure what you mean by "without taking the assessment". All the assessment does it tell you how many points you have.

However it's not possible to get an invitation through Express Entry with only 401 points. Again, that's far too low. If someone with a similar profile to you got PR - they must have done it through a different immigration program. You'll need to ask them which one.

Yeah I meant the evaluation which will simply yield a yes or no in terms of eligibility. I reckon they utilized a different program to land the PR.

You must be referring to the FSW points which require you to score 67 points to be eligible. If so, all this does is determine whether you qualify - it does not determine whether you are actually selected. Whether you are selected depends on your CRS points - which is 401 for you.

Yes exactly. I wanted to know if I was eligible. I guess am gonna have to work on some criteria in order to better my chances at being selected.

simple answer for your case. Even if you get 3 years work experience, unless something else will be improved in your profile, you can forget about EE, as you will not have enough points to get invitation to apply.

Now what can you do about it:
1. Provincial nomination - lot of homework for you, where you need to check if there is a province where you can get into their provincial program. They are rather picky thou, most require connection to province or French or just some very specific profession (list of accepted NOCs).
2. Get second University degree and improve your English score to max points
3. Learn French
4. Combine point 2 and 3 - this one is recommended.

And by the way having a 12 years old energy is pretty bad as they do not outlast adults. So maybe try to have an adult energy instead.
