Hi everyone!

I am currently being sponsored by my partner under common-law sponsorship with one dependant but the child is in our country under my mom’s care. I am in Canada right now holding open work permit.My application is on process and waiting for the medical request. I have a Consent to Travel (IMM5604) signed by my child’s biological father. I have a use of representative by the way.

My QUESTIONS are:
1.Can I get a student visa/permit for my child even if our application is still on process? What are the documents do I need to prepare? Is it possible to do it myself thru gckey to save money? I bet there will be an extra charge if I will ask my representative to do this.

2. My daughter’s biological father is also here in Canada(different province) under work permit. Is it necessary for us to sign a Custody Agreement? He signed the IMM5604 but he does NOT want to give CHILD SUPPORT,and he does NOT want to see the child in the future.

3.I am still going to submit the IMM5604 to IRCC because he just signed it a day ago. We put a cover note in the application that we will send the IMM5604 once on hand.Does IRCC require Custody Agreement? My ex and I have not signed an agreement yet since he decided to disown the child.

Please advise. I badly need your help.

Hi

1. Apply for a TRV for your child. You can do it yourself.

2 and 3. No, you don't need a custody agreement.

Can you please give me an idea regarding the TRV?As visitor or international student? Is it me(principal applicant) who can apply for it? Or my partner (sponsor)?

A visitor. You need to apply for your child.
 
One last question, if I will apply for a TRV as visitor for my daughter, can she still go to school even if she is holding a visitor visa? My daughter is 8 years old.

You would need to speak to schools about enrollment. Most will enroll a child who is being sponsored for PR.

If you apply for a study permit, you will need to show around $25000 in proof of funds.

Would it be better if I will get Visitor TRV then switch to student when the child got here? Should I ask for ACCEPTANCE LETTER prior to switching to student?

There is no point in bringing the child as a visitor and then applying for a study permit. As a work permit holder and with sponsorship app in process, you should have no issues enrolling your child in school without a study permit.

Ohh.. That answers my confusion. Thank you so much,Canuck! So basically, I will just get a TRV as Visitor for her to ENTER Canada?

Hi Nayr69sg! Thank you for the kind words. I hope everything will be fine regarding my daughter’s app. I had sleepless nights because I do not know to explain to my daughter. And if I will tell her, how painful it is for her.

I am crossing my fingers and hoping she will be with me soon.
